VW Clubman - Trader refuses refund and has had it for 4 months! - TOBY RAINLAND

The trader has refused a refund upon being presented with a "final right to reject". We bought it 6 months ago but the trader has had it in the garage being repaired for 4 months of this 6 month period. It has an engine fault which they can't seem to fix. However it's still at his repair garage and in 4 weeks time it will run out of MOT.. which means if he decided to deliver it back to me I wouldn't be able to tax or insured it because it has no MOT!

What on earth can I do? He is insisting that he repairs it. This is the 5th attempt!

We are thinking of going to county court it cost us £13k but what do I do with it when he tries to deliver it back to me? It seems he is not responsible for taxing or insuring it even though he has had possession of it for 4 months and counting!

Assuming Autosleeper Clubman VW based motorhome, yes pretty much, youngest on Autotrader is 2004. But the oldest is 1993!

This highlights one of the problems with buying a used camper van. You are paying a lot of money for what is a very old (relative to the average lifespan of a car) vehicle. While it does seem your seller may be taking liberties, you do need to bear in mind the age of it and not expect the reliability (in theory) of a new or newer vehicle. Only 6 of these on Autotrader, but £13k is the same price as the cheapest (1993 2.4D), the dearest is £25k. Engines of those for sale are the aforementioned 2.4 Diesel, a 2.0 petrol, and the remaining four are 2.5TDI's (all generally reliable)
