Insurance liability

I recently moved off from being parked on the side of a narrow road in a built up area after checking it was safe to do so. It was a dry day and visibility was good.

As I pulled out I was hit along the side of my car by a quickly moving vehicle. The other driver immediately admitted liability and said he was not looking at the road but was staring at a shop window. Now his insurance company is stating that I am solely to blame and that I pulled out when it was not safe.

There is also a statement that the other driver is now suffering a sore neck - there was no hint of any injury at the time. My insurers will not support me as there are no independent witnesses and they say the assumption is always that the driver pulling out is at fault Is it worth pursuing my case or should I just accept the situation?

Sorry, but I don't think you have any choice because you can't prove what the other driver said to you at the time and he has found a way to make a quick buck with an 'injury claim'
