My new parked car (BMW) that I have had since May 2020 was hit by a scaffold truck last Monday resulting in a damaged wing mirror (broken glass and cracked housing).
Using the anonymous note left on my windscreen with the number plate, CCTV footage from my house camera showing the truck going past my house and whilst not seeing but hearing the sound of impact and the power of social media, I was able to find the culprit at the weekend.
The driver initially tried to deny it was him but after seeing the footage and seeing the photo of his number plate, he admitted he heard the impact but thought it may have been the car behind him at the time.
He then said his reputation was very good in the area and an impact on it would be too big so he would pay and do the needful on getting it repaired. He also said it was best to go out of the insurance companies as he had previously had an impact on his insurance and would cause issues with his livelihood.


I took my car to a local reputable mechanic today and he called BMW direct to find the cost of a replacement mirror - £600 excluding labour!
I informed the driver of the cost and he said 'it was too much'. I said I would get a couple more opinions from other mechanics however how should I approach this situation?
On one side I am keen to just go via insurance however at the same time I don't want to be the cause of someone's livelihood being impacted.
I want to be fair as possible but at the same time not risk any complications getting this resolved.

The mirror on my VW Touareg was wiped out by a truck - the quoted repair cost was £1627 as it had a camera, indicators, heating and auto dimming - your £600 sounds good value, particularly for a BMW so your scaffolder will need to bite the bullet.

As an aside, the trucker's employer originally wanted to avoid the insurance but wouldn't accept the figure, so I put through insurance - which cost more with 3 days car hire for a like-for-0like big SUV.

Give him one more chance and get the money upfront otherwise straight to your insurance, not worth messing with some people. You will still have the inconvenience of the repair, is there any paint to be matched on the mirror? He does not give a good first impression only admitting the damage when confronted.

You could also point out he was guilty of failing to stop after an accident and failing to report an accident. Let him stew on that!

Leaving aside the questions of blame, who pays and how, this incident is another example of the ludicrous repair cost of fairly basic (and accessible) parts on today's cars. It makes one think about the possibility of a car being written off for the cost of a wrecked mirror ...

Sounds as though you have bent over backwards to be reasonable. The whole point of insurance is that one's livelihood is not impacted too much by unexpected large bills from accident or misfortune. This is clearly not just a cheap 'dial-a-dent' fix, so the insurance route is almost a no-brainer. Don't be influenced by his sob story. If his reprehensible behaviour came to the notice of the police he might be facing more than just a hike in his premium. Driving without due care and attention and failure to report an accident carry hefty penalties, and just might make him take more care in future.

Update - Spoken to the lorry driver again this morning and told him it was either paying the costs or going via insurance.

He said he never actually admitted liability however as I was someone local, he was willing to pay £300-£400 just to settle it however as the price is more than £600 he said the only way he will pay the actual amount is by having actual proof of his truck hitting my car.

Looks like unless I can get the footage, he is going to play the card it wasn't him.

I don't have footage of him hitting the car you can just hear it in the video I have that there was impact to a car by some car.

I have requested footage from a carpark near by that shows a camera pointing towards my car but no guarantee they will be able to obtain it...

How should I proceed?

Isn't the fact that he's prepared to pay several hundred pounds an admission of guilt? Put it in the hands of the police and if they don't deal with it (I suspect they won't), your insurance or a private prosecution. Do you have legal insurance on your house or car?

Update -
I was intending to inform the police and insurance company when I had finished work today, as per advice on here however have just had the following message from the driver -

'ive informed my insurance today, sent them the video you have of my truck that doesnt show it hitting your car. You can contact them via motor insurance database i also went into the store with the car park and he said you was lying about the video, which makes me think theres something strange going on. As i said need to see me hitting your car not just driving by you have my lorry reg please contact your insurance as i have today store was not happy today with what you have said not good my friend as i said i never hit your car my friend'

He is changing his story now and I have on a text message from him saying '£600 was too much for the repair' and both myself and cousin heard him admit his guilt on Saturday.
He also called the Garage I got a quote form, prior to my actual visit as he had put up scaffold for them and to try and get a better price before he knew they would quote £600 exc labour.

I will continue to proceed with the police report and insurance claim...

Legally, you have to tell your insurance, if you have been involved in an accident. They do ask "have you been involved in an accident in the last 5 years".

It will hurt your premiums. Even though you were n't even in the car.

I had a quick look on eBay and it seems you can get wing mirror for your car for £170 ish. Pay a mechanic £50 for fitting and the lorry driver might be more willing to pay up. Times are tough right now. You won't be any worse off doing this, than you were to start with.

My son's 4-series had the driver's side wing mirror damaged. Broken heated glass, cracked body, and broken indicator strip. The body was still attached to the door mounting.

The cost of genuine BMW parts was £200 plus half an hour of my local mechanic's time to fit them.

BMW did quote £320 to do the same job.

The mirror unit is common across the BMW range (same mirror body & glass fits the 1-, 2-, 3-, 4-series etc). Took about 10 days to get the parts from our local main BMW dealer, they don't seem to hold stock.

Assuming you've had the car from brand new since May 2020, the manufacturer's warranty is another consideration. I would be insisting on either going through insurance and making it clear to the insurance company that it should go to a BMW dealer for repair or have the scaffolder pay the £600 for the BMW repair. Getting the parts from eBay and having a backsteet mechanic fit it may invalidate the warranty on that wing mirror for any future issues (such as the electronics not working).
