No response from 3rd party insurance

My unoccupied car was hit in a car park. The third party filled his report accepting blame but advised me he was instructed not to admit liability.

My broker (Swinton) put me on to carcare who wanted to send the vehicle 50 miles away to an 'approved' repairer. I declined and went to the underwriter Aviva, they gave an alternative 5 miles away but I was unhappy they would attempt to repair broken plastic moulding and only partly respray wing, also expressed doubts about pearlescent paint.

Honda garage would replace and spray entire wing for only £100 more. I decided to pursue the claim myself so approached third party underwriter Allianz numerous times but they do not respond.

I went back to my company Aviva but they say they have had no response from Allianz over liability.

The accident happened 8 weeks ago. How can I pursue this further myself without taking legal action?

The stupidity of the situation is the third party is instructed not to admit liability by his company, who then say liability has not been resolved, even though his own form accepts he is entirely to blame.

Difficult to say other wise when you hit a parked car.

All you can now do is get competitive quotes from three bodyshops who can do the full job properly then take the matter to the small claims track of the county court. They have to put you back in the situation you were in before the damage was done and a half cock, shabby repair does not do this.
