i been hit today by a driving instructor car with his student on the wheel ,,

i was on the round about on the left lane and he was on the middle , and then i noticed that he's very closed to me so i pulled my wheel more on to my left but he follwed me on my lane and HIT me! , he gave me dirty look and went off,,

i pulled over and check my car , it has scratch from the bumper to my door ,,

i thought he will pulled over , i wait for him, but he wasnt ,, i reported it to police , but i dint get his car registration , only the name of his driving school,

now my Question and worry is,,,, IF IN CASE HE WILL COMPLAINT ( TO THINK I SUPPOSED HE DINT GET MY DETAILS AS HE RUN OFF ) ,, AND WILL SAY IT WAS MY FAULT , AND TELL HIS INSURANCE , IS THERE A CHANCE I WILL LOSS MY NO CLAIM BONUS ?

THANKS ALOT ,, ANY ADVICE WOULD BE VERY MUCH APPRECIATED ,,

It's a failure stop and report which the police will take seriously. That he left the scene considerably improves your position. They or you first need to trace the instructor. If this was a one-car operation that will not be too difficult - if it was a franchise or a chain and in a big city then more so but they should locate the culprit (and have a duty to do so).

Assuming they do then the issue of liability goes as to the facts.

The problem you have is that insurers (your and theirs) almost always try to settle roundabout accidents 50:50 and unless you have an independent witness they will probably try to do so in this case. Your position is improved in the fact that this may have been an inexperienced driver but by being so they are not necessarily at fault. If 50:50 is the agreed outcome then you will lose your no claims bonus.

You may be better trying to trace the driving instructor involved yourself (using any assistance the police can afford you) and persuading them as to the liability and that they would be better to pay for theirs and your damage. Premiums paid by instructors are high (for obvious reasons) and the chances are that if this was a minor collision he will also not want a claim on his policy.

Regrettably if all attempts to trace the vehicle concerned fail then you will have to pay for your own damage. There is limited protection under the MIBs "Untraced Drivers Agreement" but this only applies if there is an injury and will not come into play if the collision is "damage only".
