VW Polo - Which insurer has responsibility? - Scott johnston 87

Hi,

I was hit by another driver who I didn't manage to speak to at the scene.

I managed to catch his registration number and submitted a claim to my insurer. After hearing nothing for a while I contacted them- they told me they had recorded it as an incident but as I only had third party cover they wouldn't take it further. They gave me the name of the other drivers insurer and told me to speak to them directly.

I then submitted a claim with the Third Party insurer. After quite a long wait I found out the other driver had admitted liability. The Third Party insurer then sent details of this back to my insurer.

My Insurer are telling me that I should deal with the Third Party insurer while the Third Party insurer are saying they have sent details to my Insurer and it is up to them to sort it our.

Can anyone point to something definitive which states which insurer has responsibility in this situation given that the type of my insurance is Third Party fire and theft.

Communication has been non-existent from both insurers and I have no idea of the status of my case at any point in time.

You'd need to read the small print in the documentation you got with your insurance.

Do you have that "motor legal assistance" add on? It sounds like not if they won't help.

It might be worth telling the other parties insurers that you'll refer the matter to a claims company, that often speeds them up.

I had a nightmare of a time with Churchill when one of their drivers hit me. Nothing happened for several weeks.

A local garage gave me details of a claims company who took on my case at no cost (the other party's insurers would be liable for everything).

As soon as the expensive hire car turned up and they informed Churchill that they'd be handling everything I was paid up within 7 days!
