Hi there,

I've recently bought a 2006 Nissan Note from a used car dealer and have unfortunately discovered I may not have checked it over well enough. There is what I would call excessive movement in at least the drivers side engine mount. This movement is enough that I can feel and hear it in the car, especially when setting off. Should this have caused the car to fail an MOT? It got an MOT the morning I took delivery of it (today, 28/11/22), but looking at this I feel like it should have failed. I intend to go back to them to ask them to fix it, but I want to make sure I'm correct in my assumption beforehand.

Just ask them to fix it. I had an Octavia mkI owned from new that developed a strange noise and it was a similar engine mounted to the chassis but holding the gearbox. It had not been spotted in service or MOT but it kept having exhaust joint issues after downpipe / catalyst. I ended up diagnosing a knock on acceleration myself using a paintbrush handle pushed in - more vibration but knock disappeared. Mount was replaced that fixed the noise and exhaust had no further issues - clearly the excessive rotation of the engine block was causing this.

Make sure they fix it as there is a word of caution here - when the garage replaced it they said that many of these are fastened into captive nuts within the chassis and if the bolts are seized in and captive nuts break off(mine was ok) - Houston that's a BIG problem involving cutting/welding. I mention this as the securing bolts look different in the video? If they can't fix - reject the car.

Thanks for the advice! Hopefully it's an easy fix and doesn't end up with broken bolts or captive nuts! The dealership is reasonably well rated so hopefully this won't be too much of a pain.

Are you sure that’s the mount making the noise ? Sounds like it’s coming from somewhere else . Possibly exhaust system ?

Definitely can't say I'm sure. Might not be directly coming from the engine mount, but I think the movement it's allowing may be causing something else to make noise (i.e. rocking engine causes exhaust to come into contact with subframe or something to that effect).

I'm new to the country and in a terraced house with no off street parking so my ability to do much diagnostics is very limited. Definitely missing my tools and garage right about now!

Just take it back - in this country you have strong rights buying from a dealer, especially just after you have bought it:-

I wouldn't bother pursuing MOT route - it'll only fail on the day if the tester spots, except to put on the ramp cars aren't usually driven (ignoring some 4x4 brake checks etc)

Having done a bit of extra research since posting this I think even if it had been noticed it may not be an MOT failure. But you’re right, I do have those rights having bought from a dealer so I will exercise them. There’s a couple other things wrong, like blower speeds 1 and 2 not working so I’ll ask they sort that too. Hopefully if I’m polite but firm with them it won’t be an issue. I’d rather have it fixed and keep it since it’s quite tidy and was a good price, and I know even with the law on my side it would be an expensive battle if it came to it.

My only worry might be that a trader dealing in 16-year-old cars may not be particularly accommodating when asked to fix faults like this - at least for free. He could expect some payment ?

I definitely have the same worry! It was £1,800 so I can’t imagine there’s a huge amount of profit in it for them. I’ll try my luck but will be willing to compromise with paying some of it if they play hard ball.

MoT inspection manual....6.1.8 (a) ( i)............'severely damaged or deterioration resulting in excessive movement....'

You are in the hands of the examiner and their interpretation of 'excessive'. Sadly, their opinion almost always trumps yours, especially when the measurement is unquantified. However, I think that easily producing a noise of something banging against something else adds sufficient weight to your opinion that the movement is excessive enough to fail the MoT, and should not have passed. That should outweigh their opinion that it was OK. In view of the small timeframe, their counter argument that the deterioration might have occured since the test would carry very little weight.
