Audi A6 Allroad - Engine failure due to faulty part - mdfe

Hi,

I feel I am at my wits end and am finding Audi Uk to be totally unreasonable.

The saga:

- Audi OEM cambelt kit fitted by an independent

- 130 miles later the engine lunches itself, investigations discover a tensioner bolt, part of the new auid oem parts, had failed prematurely

- Audi dealership examines, Master tech agrees with this finding, warranty manager reverses this story and rejects claim saying parts had been fitted incorrectly

- no amount of dicussions or demonstrations that show the part was not and could not be fitted incorrectly get anywhere with dealership

- I commission an independent engineers report (valid in a court of law) that support findings that the parts have not been fitted incorrectly

- case with Audi Uk raised and report provided

- approx 24 hours later Audi Uk after a supposed detailed review they ring and tell me (in an agressive manner) that 'parts have been fitted incorrectly, we do not question or review dealership findings, we will not consider any independent engineers reports whatsoever'

so there it is, finding it really hard to have a sensible discussion or correspondence with them. I have not recieved ANY correspondence as to the detail of their findings. It feels they are forcing me to push for a small claims court finding as the only way of them looking at the evidence and the case on a reasonable level.

Hi mdfe, you have my sympathy on the failure & the no doubt expensive damage caused, but i am intrigued as to why you belive Audi to be responsible (& I'm perfectly happy for others to put me right!)

I'm guessing the vehicle is not within Audi UK manufacturers warranty; not because you have used an independent but because a belt change was due. Could you let us know the age & mileage of the car, please?

So, if it is outside of the manufacturer's warranty period, surely liability (under UK law) lies with the person you purchased the kit from ..... the repairer. So whether it was the part or the fitting which was faulty the repairer is liable. If the repairer is able to recover any of HIS costs from Audi UK then good luck to him, but this should have no bearing on his liability to you.

If I were you I would write to the repairer to this effect informing him that should he not repair all the damage you will take HIM to court. Or was it the repairer who suggested you try to claim through Audi in the first place?

thanks for the reply kit came from a VAG group approved parts distributor, all new OEM audi parts have a 2 year warranty, therefore am claiming for the resultant damage and destruction of the engine due to premature failure of a brand new audi part - 130 miles following fitment and subsequent failure!

vehicle is out of warranty anyway (2005 with 60k on it), I would not usually trust audi dealers to perform a cambelt change with all the correct parts, based on previous experience. my independent has been liasing with audi who supplied the faulty part but to no avail, I will be getting the car back on the road, my independent is stepping up to the mark on this - just seems totally unfair we have to stomach the costs and loss of vehicle (6 months) for something caused by a faulty part from audi, covered by audi warranty. hence the independent engineers report - which is pretty conclusive,

they say the report is irrelevant and only an audi inspection finding is valid (already performed by my mechanic, engineer and their mastertech who all agreed the cause was premature part failure initially - now the story from audi has changed - I don't have this in writing from audi unfortunately - they only seem to deal by telephone it seems. I hope to have the audi uk claim rejection in writing soon, to which I will respond setting out the inconsistencies, I do feel I am hitting a brick wall with their total refusal to look at the independent evidence.

You have done everything correctly so far and you seem to have good cause to claim against the part warranty.

Hi Lucy, you're obviously more knowledgeable than me on this (& any other legal matter) so perhaps you can tell me why the customer would have a claim against the manufacturer's parts warranty when he did not purchase it from them.

Like I said earlier, I would have thought his claim would have been against the repairer who suplied & fitted the part.

It looks as if you are saying that the parts warranty transfers to the owner of the vehicle it is fitted on; yes?

The claim is against the repairer but if they fitted the part properly and it failed (as appears to be the case) then there is an upward claim on the parts warranty.

To give a more clear-cut example (perhaps from days gone by) if a new cylinder head block was properly fitted by a garage but there was a casting fault and a piston shot through the side then the ultimate claim is against the provider of the faulty block.

This may pass through several hands on the way. Who sues whom can be complex in these cases and may vary case by case but the OP seems to have bought a warrantied part, it was properly fitted and it failed on him.

All the evidence (including the independent evidence) seems to support his claim and there is a possible challenge under EU regulations which seek to prevent manufacturers favouring their dealers unfairly.

I get the impression the main dealer is playing games.

If there are any companies named (other than manufacturers) can moderators remove them as this could go legal.
