Hi

while reversing out of morrisons yesterday i hit a car behind me. I am sure the car wasnt there when i began reversing and i checked several times, however i hit him, it was my fault. I think he drove up behind me as i was reversing

As soon as i felt the bump i jumped out of the car and went to see the damage.The driver of the other car didnt even look bothered or want to get out. eventually he did and i actually knew him from a town i use to live in. I said that i knew his face and he knew mine as he knew my ex wife and family.

anyway, he said i had cracked his driver side headlight, the wing also looked damaged but as far as i know or recall he never mention this.I told him i would sort it to which he replied no it ok, dont worry. he asked me to check his indicator still worked, which it did, again said dont worry got in his car and left. He was staionary at the junction to turn right as i turned left, so was beside him for a short period.The car was old and i could see was other damage as well

there is no damage to my car at all, not even a scuff, i was going v slowly as i had almost stop the reverse move

My question now is, on reflection am worried sick, only been driving 20 months and i have now been told that failure to report it to the police no matter how minor carries a 5 -10 point penalty. It been more that 24hrs now, which according the internet is an offence. another friend said to forget it as the other driver most likely had something to hide, but i am worried he took a note of my reg, may report me, say i failed to stop and claim damages.

The only way you are going to get points for this is if you "failed to stop and report an accident" - that or "driving without due care and attention" - which normally follows on from failing to stop and report in supermarket car park accident cases.

Had you bumped his car and left the scene and been witnessed by a third party doing so there is a potential "failure to stop" charge. Had you left the scene and failed to report the accident there is a potential to charge you on both failure to stop and failure to report. In many cases if the police get a failure to stop and report they will throw in a due care and attention charge for good measure.

However you did stop and you had communication with the other driver. In these circumstances there is no responsibility to further report the accident to the police.

From what you say it appears there may have been pre-existing damage.

In any accident it is prudent to:

1. exchange addresses with the other driver (so you can prove you did stop)
2. get details of an independent witness if you can
3. take good photographs of any damage - particularly if you can show any rust which might suggest the damage was from a previous accident

I would be amazed if any more came of this but as you have probably not done any of 1-3 and above it might be as well to report it to the local police along with the circumstances and have it recorded that you have done so.

Without a complaint from the other party it will not go any further in any event and by reporting it yourself you will have strengthened your position.

Once you have done this please come back to me if you hear any more about it so I can advise further. But frankly I don't think you have much to worry about and if there is any comeback I would be confident we could mount a successful defence for you.

As i stated i got out and spoke to the guy, we never exchanged names or any other details. I didnt even think of asking any wittnesses. He more or less said not a problem and left.I know nothing about his car or him, even though i knew his face from where i once lived.

i was going to report it to the police but the incident was over 24 hrs ago now and i understand this is an offence in its self. I would rather just let it go and hope i hear no more

You probably won't hear any more but you haven't broken the rules because you stopped - so reporting it late is an insurance policy. By reporting it at all you are exceeding your legal obligations.

sorry to be a pain lucy as i am a worry wart.

I will just forget about it and move on, my worry would be if he reported the incident to the police and said i didnt stop, but i think i am being overly worried,
