Good morning,

I'm in dire need of some advice here regarding 80+ bus lane fines that I have acquired over the past year, of which I had not received a single letter to my address.

I am a 22-year-old student studying in Manchester at the moment, using my father's VW Polo to commute. Since September 2017, I have stupidly been caught driving on bus lanes over 80 times.

Because the vehicle was registered to my father, I did not receive a single letter regarding my recurring mistakes. My father did not receive any letters either, because he had relocated to Pakistan and left the car in my hands. He failed to update the DVLA or any councils that he had made the move, and that his previous address was no longer occupied by him.

Over the past few months, my mother and I have had to pay around £3500 for around 20 of these fines that had gone to the late and debt collection stage. We did not receive any letters regarding any of this because my father's previous property is now being rented by tenants, with whom I have never had any contact. I have no idea who they are.

As unfortunate as this situation was, I thought everything was in the clear after having paid £3500 and being forced to move out of Manchester and move back in with my mother due to these fines.

However, I inquired with Manchester City Council again to double check whether everything was sorted. They replied saying that there was an additional 60+ fines still on the system registered to this vehicle.

I have phoned them up and the fines have been put on hold for now. They are asking for the registered keeper to contact them (they think this is still my father), however I have changed the V5C registration over to my name. Besides, it was me who committed these offences in the first place. My father has not been in the UK for 3+ years.

I have given Manchester City Council all of my savings and have had to borrow £1500+ from my mother to pay off the initial fines. I cannot afford to have to pay off another 60+ fines, I simply have no money left and do not earn much as I am a student.

I'm in a bit of a desperate situation now I'm afraid. Any advice at all would be incredibly appreciated.

The bus lane signage in Manchester on Oxford Road is bizarre. It does not explicitly say 'BUS LANE' on the road itself. There are some signs along the road, and you are able to drive only on some parts of the road and not others, only in certain directions at certain times. I had only just started driving so I did not fully understand this.

As a new driver, I would think you'd read the highway code, or your qualified passenger/instructor had.

Didn't you wonder why no other cars were in front and behind you on the bus lane - 80 times?

Every now and then, I find myself driving down a road where all the parked vehicles are facing the other way. I have to do a mental re-cap to make sure I haven't passed a 'NO ENTRY' sign.

It would appear you may also failed to pay the RFL - road tax

Failed to report the change of keeper or address

Failed to obtain insurance in your name?

This is all going to cost you an enormous sum of money.

Road tax has been paid.

I changed the V5C ownership over to my name and address last month.

Then with +80 penalty notices you need to seek legal advice, or Citizens Advice service, 80+ tickets could mean £8,000 plus

Are you seriously saying that on all 80 occasions you'd no clue or idea you were in a bus only lane?

The only way enforcing authority can possibly trace driver is by pursuing the person registered with authorities as keeper. How do you think you'd get letters rather than your Father as the keeper?

You might get some help from Citizens Advice but it will be about dealing with debt, not how you can escape (or rather evade) the penalties you have incurred.

Clearly - if the car had been properly registered in your name at your address, you'd have received the first letter, dealt with it and learnt your bus lane error for the cost of one fine - that means your lesson to learn about registration address will cost you 79x the fine.

You're going to have to pay those fines - take Citizens Advice and come to an arrangement to pay them off.

Illegally driving in a bus lane (sorry I don’t believe you could do this 80 times and not know) and illegally not registering your car properly. The rules of the land apply to all of us whether you agree with them or not. You tried being a fly-guy and thought you could beat the system but got caught out. Learn from this! Play by the rules, work hard, pay your taxes and live a good life and you’ll get on but scam and scheme through life and you’ll get bitten.

Driving in a bus lane is not an offence, it is a CIVIL contravention enforced by councils.

Failing to register a vehicle with the correct driver name and address is an offence - Mags Court etc.

V5 must always by up to date.

If you think the signs were poor then you can appeal the ticket.
