Hi All,

I've been reading this website for sometime and have always found it helpful.

So, I was involved in a car accident last week. When the police arrived at the scene they interviewed me under caution and briefy explained that whatever I said could be used against me.

All I remember was driving one minute and the next thing I know, I've hit a bus stop signpost. Luckily no one else was hurt or injured. I had to go A+E for whiplash. When they interviewed me and asked me what happened I said that I may have fallen asleep but I'm not sure how to really explain. I explained the same for insurance. I have read online and read that I could be charged with dangerous driving and be disqualified from driving as I have only passed my test about 1.5 years.

I tried following up with the police on whats going to happen next and I have not heard from them since.

Can anyone advise me what can I do next or how long does it normally take for things like this to be processed. Also what is likely to happen? Am I really anxious about it don't know what else I can do.

There is no 'normally' in a case such as this, unfortunately.

The police will compile their file, and then send it on to the CPS, along with their recommendation as to what (if any) charges should be brought. The CPS will then look at the file, decide on the likelyhood of a conviction depending on the evidence, and then either charge you or not.

It might take anything up to 6 months until you hear anything (though the legal time limit used to be 3 years, not sure if that still applies or not). You might never hear anything on it again. The charges (if any) could be driving without due care and attention through to dangerous driving (though I'd think the latter unlikely).

Even if it went to court, you'd still have to be convicted, and then the court decide on the penalty points (or disqualification) and fine if you are convicted.

Sorry to be so unhelpful, but the reality of it is that these things can take a fair bit of time to be resolved.

sleep apnea is a possible here, might be worth going to your doctor to get checked for this, its surprisingly common, can be treated successfully i know several people who have suffered including temporary loss of HGV licence until cured, now doing fine.
