My question is - the car has been rejected, the car dealer has refused to accept the rejection - who owns the car in this case? DVLA has been informed, whose responsibility is the insurance of the car?

Bought first car in July - turned out faulty. Car dealer offered an exchange. We didn't have much choice. The dealer refused to give the money back. The scond car had an oil leak, which we were promised would be fixed. However, When collected the car we heard a noise (engine noise). The car was sold with a one year warranty. We were told everything would be fixed. Left a car for nearly two weeks. Got the message saying 'all works completed' - oil leak was fixed. The noise was still there. We were not even told this wasn't done. Car dealer very rude. Told us to go and never come back! The car broke down about two weeks later. Meanwhile had it inspected at the franchised garage who said they need to strip the campbelt to investigate further but need to know this will be paid for. A local garage checked the problem and also admitted only Approved Garage can fix it. The car is 4 years old. We had to change the alternator as well. Again the car dealer refused to pay for the repair although when we wrote a formal complaint he sent a text message promising he was going to pay. He hasn't so far.

So if it's 4 years old, then you aren't in the UK. I suggest you find a consumer affairs and consumer protection website in your own country, and find out what the legal situation is in your country.

In reply to your original question regarding insurance : I'm pretty sure you are responsible for insuring it at present. I'm not sure, but I don't think you have a legal right to just unilaterally reject the car, especially if the dealer refuses to accept it. You'd have to go to a court Small Claims Court) to force them to accept it and refund you.

As to informing DVLA ... well, you seem to have jumped the gun a bit.

I'd suggest you need to calm down a bit, and possibly try to get someone neutral and who can keep control of their emotions to try to deal with the garage. After your first rejection, and then more problems, they've probably pegged you as a right pain in the backside, and they're just sick of having to deal with you.

Thank you for your honest advice. It's a complicated story. I am just trying to find out what my rights are. And it is difficult when one has to deal with a dishonest person and trying to cope without a car at the same time.

Anetta, you may get some useful help from Citizens Advice. Go to their website www.citizensadvice.org.uk/ select the part of the UK where the car was bought and then follow Consumer link.

Alternatively give them a call on 03454 04 05 06.
