parking charge notice question - tamzzy

hi guys

just wanted to ask, so i parked in a private car park yesterday and today, didnt move the car, i came back to find 2 parking charge notices on top of each other dated 9th and 10th.

now i havent moved the car, and the 1st pcn was still on the screen.

stupidly i didnt take a photo of the 2 pcns on the windscreen.

1. do i need to pay both charges as its the same offence (evn though now i dont have proof except that the pcn wrappers are on my desk)

2. i'll have a look again, but can i appeal the tickets on technicalities:

a)i dont remember seeing any signs that the car park was enforced - or if there was, it wasnt very visible

b) on both pcns they stated my car was grey but its actually green, rest of the details are correct though (would (b) on its own suffice)

3. how successful is appealing?

The colour of the car is irrelevant if they have the registration correct. Don't pay and see what happens, I suggest. If the signage wasn't clear how did you know it was a private car park? If you didn't photograph the notices on the screen and whatever signage there was you aren't going to find it too easy to make a case for appeal.

Are you sure it's a private car park and that you've got a Parking Charge Notice?

Unless the signage was non-compliant then (assuming you had not paid the correct charge) I don't think appealing is an option. You could try ignoring them but watch out for any County Court Summons as at that stage hard ball begins. See Pepipoo for more detail on process and tactics.

If they're actually Penalty Charge Notices issued on behalf of the Council then my advice would be to pay up on both while you've got the discount.

i know it was a private car park cuz the car park was a residential closed compund car park. i went to stay over at my friends. we didnt know that the management of the apartment complex changed the parking rules and im pretty sure there were no signs at all to say that the car park was now enforced.

Visit Pepipoo for sound advice. Lots of detail missing from this, but if it gets to the official appeal channel the chances of winning are now in the high 90s. Giving the appeal panel evidence of the loss to justify the charge is proving an expensive headache for operators.

You may also want to google "parking prankster" and read his blogs.

what kind of detail do you need, perhaps its just my oversight not including them in the opening post

Complete photographs of the signage and notes of whether it was placed where could easily be seen would be a goood start.

Where was the car park? If Scotland different rules apply.
Who is the operator?
Are they members of the BPA? This is important.

Are three to start. Pepipoo will help. If you search their forum for the operator who gave you your invoice I'm sure there will be similar cases to yours.
