Parking Ticket Appeal - Apcoa - shushione

On a daily basis I park in my local train station car park. I dont commute in the normal rush hour and when I get to the station to catch a train leaving after 10.00am, it is difficult to park as the station car park is almost at capacity. I always pay by the same method, via my mobile phone.

In May, I parked my car it a fairly tight spot, parking between two cars and as this was bay was directly opposite a line of parked cars at right angle which makes it difficult to get into. I parked and paid by usual method, via mobile phone.

I returned to collect my vehicle after 7pm in the evening and to find that it had a ticket on the windscreen. My first though was how do I print a copy of their text message to prove I parked!!! To my horror, I had not received a non payment fine but I had received a fine for parking within two bays. A photograph was taken as yes, at the point of taking the photograph my car was clearing shown as being over the line of the second bay.

I appealed the ticket, writing to them and explaining that I parked between two cars so someone else had set the presidence - it was obvious to me that there must have been a line of cars parked in the same way as I had parked between two cars. There is little or no choice in where to park in this busy car park at 10.00am

I have received a letter back saying that they have declined my appeal and I can pay now, a fine of £50 or I can appeal to POPLA and it will cost £75 if I lose the appeal.

Since the ticket issue happened I have been made redundant and I can therefore ill afford the fine far less the additional cost if I should lose an appeal. Any advice would be gratefully accepted - should I risk an appeal?

Generally most peoples who issue parking fines refuse/decline any appeal.

I believe that a significant percentage of peoples attending an appeal hearing win.

Your only option is to go to the appeal hearing and present your evidence/explanation

If it goes against you, since you are not employed you can seek time to pay

Was this ticket given under a railway byelaw? You need to revisit and look at the signage. If so you could be in a situation where payment is the best option.

If not it is probably a private ticket and POPLA will be the appeal process if your initial appeal fails.

You don't appeal using mitigating circumstances, or that someone else was over the line so you had no choice etc as you will lose, but this still does not mean you have to pay, despite what APCOA may say following a 'victory'.

You appeal on the basis of Apcoa not having the correct authority from the landowner to issue tickets and also that the amount requested is not a reflection of the losses incurred. Its then down to them to show they have Authority and also provide a breakdown of losses. Case after case is showing you will win as PPCs are very reluctant to reveal the contracts they hold with landowners and proving a loss when you paid is very difficult, cos there aint one.

There are also issues regarding timings and serving of letters etc etc which could strengthen your appeal.
