I was travelling towards the M3 in a 70 limit. The lights changed, I slammed on the brakes and came to a stop a few feet over the line. The camera flashed twice,probably showing that I was in the same place on both photos.

You're heading towards a green light. It's been green as long as you can see it. The next stage is for it to go amber and then red.

I've never met a set of lights that, treated with caution, made it dificult to stop without fierce braking when driver was on qv.

But, a colleague was in a similar position, but mitigating circumstances were that his baby son who was sat in the back had just been sick. He appealed with a phone call, they reviewed the pictures, assessed he hadn't completed his manouver as he actually stopped and reversed back to the line and they cancelled the ticket.

If you were just over a call may be worthwhile.

If any part of your vehicle goes over the line it is an offence. Whether you could get it dropped would depend on the leniency of the police. Certainly if it went to Court you would be convicted.

Traffic Signs and General Directions state:

Significance of light signals prescribed by regulations 33 to 3536.—(1) The significance of the light signals prescribed by regulations 33, 34 and 35 shall be as follows—


(a)subject to sub-paragraph (b) and, where the red signal is shown at the same time as the green arrow signal, to sub-paragraphs (f) and (g), the red signal shall convey the prohibition that vehicular traffic shall not proceed beyond the stop line;

In the case mentioned the vehicle passed the line therefore OFFENCE - cut and dried.

Worth a letter to see if there is any heart at the sending office.

dvd, my point was not with what the statute says, it was more the brazen comment "Certainly if it went to Court you would be convicted." As we all know, there are a miriad of reasons as to why a conviction may be avoided. E.g. 1) were the lights in working order, 2) was the line crossed under the direction of a police officer, 3) was the line crossed because the road surface was in such a condition that made braking in time not possible, perhaps through spilt diesel. Emma's law firm would not be doing business if a conviction was a certainty.

The OP does not contain anything to suggest (1) or (2), which are exceptions, might apply. He ran past the line wile the signal was red; absolute offence and conviction inevitable.

Condition of the surface might be mitigation for court to apply a lesser or even in extremis nil penalty. Still a conviction though.

Emma's firm (whatever it is - do you mean Lucy's?) could take a fee for the good advice given yesterday. Other offences with more scope for defence/hook wriggling just make her outfit more viable.

Hard luck rustyrenault, seems are bit harsh to get a possible fine for just over the line. As you are aware though the offence is absolute e.g. you crossed the line. Very little 'wiggle' room. However if they contact you, a nice letter back explaining that you were trying not to brake too hard out of concern for the other occupants of the car and you misjudged the distance slightly, no harm done. Worth a try. Good luck.

I know it's a bit late now, but I did learn never to 'race' the traffic lights, just not worth the hassle of near misses, heavy braking etc. Cheers Concrete

Yes you will as you passed through at red.

I got flashed 3 mth ago and received notice of intended P but with an offer of a Whats driving us course, if I accepted there would be no fine or points, the course fee £85.

The course was 3hr classroom based and was psychology based interactive about 20 others, it was not run by Police officers and its aim was to make you think about your driving and the consequences of some of your actions and reactions can have.

Very interesting and thought provoking.

These cameras flash well after the lights turn red. Not as they turn red and you cross the line. Hence I deduce you had plenty of time to stop and were trying to beat the lights on red, saw the camera and decided to stop hoping to not get caught. Caught fair and square, accept punishment and move on.
