Any - EU 261/2004 (cancelled / delayed flights) - nick62

Flight home got cancelled a couple of weeks ago and re-booked flight arrived 6 hours later (approx. midnight).

Airline (German National) have admitted €250 statutory compensation is payable, but are refusing to pay out the additional £50 taxi fare home from the airport, (trains stop running after 11 pm).

SWMBO normally picks me up for tea-time arrivals, but she wouldn't turn-out after midnight, hence the taxi.

Under the regulation the following applies:

"Applicable law and court precedents indicate that any extra loss incurred directly as a result of the disruption should be covered."

A simiar situation happened to us as a family of four flying with Easyjet last year and we ended-up flying into Gatwick instead of Liverpool. Easyjet paid-out 4x €250 compensation + the rail fare from Gatwick to Liverpool for us all without quibble, (which was very expensive).

Can anyone state where I stand, as I could not see Easyjet coughing-up if they were not duty bound. I think the Germans are trying it on?

Easy paid for hotel overnight for my son when his flight to Gatwick was delayed too late to get beyond London. Not one they arranged; I booked it for him when extent of delay became apparent.

Would suggest a polite but firm request that decision not to pay taxi be reviewed and/or referred to a manager.

The Luftwaffe are playing hard-ball and have told me to refer my claim to the equivalent of the German ombudsman, as they will not answer any further correspondance on this matter, (it reminds me exactly of VW UK Customer Service)!

The ticket cost from Gatwick to Liverpool was paid because they had to whereas your taxi costs are not covered in the directive so they will not be paid.
