Has the Volkswagen emissions update ruined my Tiguan?

I purchased a 2011 Volkswagen Tiguan in 2013. The car had 9000 miles on the clock and I bought it from a car supermarket. The vehicle has now covered 49,000 miles and has a full dealer service history. Last week I took it to the dealer for the MOT, during which they asked if they could update the software to fix the emissions fault.

Since getting e car back I have covered 40 miles and found the clutch to be slipping. The car is also leaking oil. On phoning the dealer I was advised to arrange transportation to the garage at a cost of £85 followed by the proposal to carry out diagnostic testing at a cost of £73.

On meeting with the service manager, I have been informed that this is a known problem which has affected Tiguans, Golfs and Passats. He stated Volkswagen will pay 70 per cent of the price of the parts and half of the labour costs. This will still leave me with a £1100 bill, covering the replacement of the clutch, flywheel and gearbox. Has the emissions update contributed to this mechanical failure and what responsibility does Volkswagen have to sort this out?

Nothing to do with the emissions fix. An entirely separate problem. I'd ask for an explanation of why you had to pay £73 for a diagnostic check for an oil leak. Since when were computers used to find things that anyone with a pair of eyes can see? But, since you're apparently getting a new clutch, DMF and transmission for £1100, maybe better not to rock the boat until it's all done and then afterwards try and claim the money back.
