Can I insist on a replacement part rather than a repair after my Ford Galaxy was reversed into?
My parked 5-year-old Ford Galaxy was reversed into causing damage to the bumper, hatch and tow bar. The driver's insurance assessor has inspected my vehicle and is insisting the hatch is repaired. I don't think this is fair as I feel it will depreciate the value of my vehicle. His reply was 'claim off your own insurance if you want a new one'! Do I have a legal right to insist on the hatch being replaced or will I have to settle for a repair?
