Should I answer questions to solicitors regarding an accident I witnessed over the phone?
I witnessed an accident on a country road two years ago and gave a witness statement to the police at the scene, as did one other driver. I believe that our accounts may have differed. I have recently been contacted by solicitors of both parties. One has asked if I will answer some questions over the phone and the other has sent me forms to complete on the basis of which they will prepare a statement for me to check and sign. One party is making "a claim for damages". Past experience with the legal profession suggests extreme caution in this situation. I question whether solicitors should be allowed to make such requests, particularly after such a time gap. I would be interested in your opinion.

If you do not believe you can remember the details precisely, then tell them exactly that. If, through lack of memory, you provide incorrect information and it is taken to court, you could get done for perjury. Refuse absolutely to answer any questions over the phone as they will be recorded and could be used against you.
