I was parked in a public pay and display car park when a car reversed into the space next to me. Once the car had stopped (and the engine had been turned off) a child of about six hit my car with the rear door, causing a lot of damage.

The mother was deeply apologetic and offered to pay and sort the damage out, but I have since heard from her husband (who wasn't there) who told me that they will not be paying or entertaining a damage claim against their insurance.

The husband says that the car was parked and the damage was caused by a child. He says the car wasn't moving and that they cannot be held responsible for the actions of their child in this instance. Is this cortrect?
