BMW won't pay for a repair under warranty

In late January I purchased an 04 plate 645ci from a BMW main dealer. It came with a full year's BMW used car warranty.

Since then, the car has been into my local dealer's due to blocked boot drains flooding the amplifier. This has now been fixed under warranty. On its last visit, I also asked them to take a look at the roof mechanism which was making a 'crunching' noise when shutting and a piece of the trim appeared to be missing when the roof was retracted.

They responded to say that they could see a fault but that the car had been repaired and this was the likely cause of the fault. The BMW warranty does not cover third party works. Needless to say I wasn't informed of any such repair when buying the car which came with a full BMW service history.

My local dealer said it would be up to the seller to pay for the work to be done but they have been strangely silent on the matter since I contacted them.

From my perspective, the warranty covers mechanical defects (which this clearly is) and I am not really too bothered about what's causing it or who pays, so long as it's not me!

What are my rights and what should I be saying to whom to get the process moving!

Your rights are solely against the dealer who sold you the car. The warranty provider is not responsible for faults that were present or developing on the day the car was sold, but the dealer who sold you the car is responsible for them for 6 months from date of sale.
