Recently I went into a car park at a motorway service area to make a phone call. As I wasn’t going to go into the services I parked at the back of the car park around no other cars. Once finished I started reversing out and saw a car coming down, so I waited for it to pass, but instead it hit the side of my car. When I got out of my car the driver stated he wasn’t looking where he was going and was looking out of the side window to find the exit, not even looking in front of him. We agreed to give each other our phone numbers and to settle our own damages. However he has now phoned me saying it was my fault and I wasn’t looking where I was going. I understand that I was reversing and therefore he has the right of way but I was also stationary and he had plenty of room to move out of my way as no other car was parked within at least a 20metre radius from myself. What is the best approach to take? And would I win my case if the insurance companies got involved?

On the basis of recent reader experiences, don’t involve any insurers. My ex-wife did something similar many years ago. I just paid the guy off, £150, and get a scrap bumper to fix her car. At the time I could have bought the guy a replacement car for £50, but better to settle and get him out of our hair.
