I received an APCOA "Parking Charge Notice" yesterday relating to being seen picking up or dropping off outsife of a designated parking area at Luton Airport 29/12

The fact is, my car's engine failed 10/12/12, and was recovered from the M4 to my home where it has sat on my driveway ever since, undriveable. Having had a mechanic confirm it is beyond economic repair a couple of weekends back I have even suspended the insurance policy and applied for the SORN to get the tax back - both of these actions were taken last week and the APCOA notice was received yesterday.

My inclination would be a letter outlining the details that it can't possibly be my vehicle but, even with the changes last year to the Protection of Freedoms Act, there seems to be a number of people suggesting that under no circumstances should I engage in correspondence with them.

My situation is different to those who have parked outside a marked bay in error, or returned later than anticipated - my vehicle was uncapable of making the journey!

Recommendations please?

In this particular case, if you really can prove that the vehicle was off the road at the time, then I reckon that sending that proof along with a covering letter telling them to get knotted is the right approach.

IGNORE it it's not worth the bother I had one not that long ago from them at Luton airport, you'll get another couple of letters soon making all sorts of threat.

Then you'll geta letter from George White solicitors I think it was something like that anyway. Again it's rubbish and George White are APCOA only a diffrent name

Great advice cA6dders but last year they brought in new legislation that in such cases they can chase the Registered Keeper (used to be only the driver) where driver is not known ( ticket not paid) and take it to County Court.

I admire your Clint Eastwood stance in that can you guarantee they will not take it right down the line to Court???????? "You feel lucky punk?

Here the poster has a legitimate and proveable case for non payment and to save postal hassle in his shoes I would write to them.

I'm with DVD on this one.

Advise APCOA of situation with your car. Does the recovery report confirm the nature of the breakdown - if so consider sending them a copy. Express concern as to possibilty of cloning and ask for more details of evidence eg CCTV or parking attendant's report.
