BMW530D SE - Excess Speed 58mph - 50mph - Paul Cambs

I have a clean licence and have had this for 5 years+ unfortunately I committed a speeding offence on the Dartford crossing, i.e. 58mph in 50mph automatic camera zone

My question is whether it is normal to prosecute or whether a speed awareness course would be offered.

The notice received states that by "if you qualify for a speed awareness course this would have been sent to you" therefore as I received the notice I presume I have not qualified!

I accept that you do not automoatically have the right to an awareness course instead of points however I am trying to understand whether any option exists, i.e. appeal or it is just the luck of the draw. In simple terms what are the qualifying factors?

Any help or guidance gratefully appreciated

Worth asking if you can have a speed awareness course, shows that your being responsible about it.

Speed awareness courses are not offered by all Police forces and normally for a minor infringement which I'd have thought 58in 50 was just that.

"Ask it may be granted unto you."

You were only 1 mph into the fobidden zone so they may well take pity on you if they are operating the scheme.

The ACPO guidelines for offering a Speed Awareness course is from speed limit +10% +2mph to limit +10% +9mph - subject to various other conditions.

So in a 50mph limit the course would be appropriate for those doing 57-64mph.

But of course, not all police forces adopt the ACPO guidelines and even those that do aren't obliged to follow them in every case.

Don't lose sight of the fact that 51mph is a criminal offence in these circumstances - anything other than a court summons is a bonus based on practicality, not law.
