APCOA Enforcement Notice - angrybird

I receied a Enforcement Notice from APCOA giving me the opportunity to pay a fine for stopping/dropping off in a non drop off area. I wrote to APCOA informing them I was not the driver at the time and gave the address of the driver. They have now written back to me telling me that although you were not the driver on the day of the Notice was issued as the vehicle is under your name therefore you are liable to make payment. is this correct? I dont see why I should make the payment on behalf of someone else and feel it is not my responsibility to chase payment for reimbursement if I pay it! What does the law state on this matter ..... clues please

Where did this happen and what exactly does the Notice say about the powers under which it was issued?

At the moment, generally speaking (at least in England and Wales), penalties for infringements on private land are a contractual matter between the driver and landowner. The Protection of Freedoms Act 2012 changes that and in future the liablity will rest with the keeper. That section is however not yet in force, expected to come in during the Autumn.

If however APCOA are acting for a Local Authority then they're already likley to have power to enforce via the traffic unit at Northampton County Court.

If issued on an airport or railway land their may also be a power of 'criminal' enforcement via magistrates court.

it happened at East Midlands Airport, on the public highway, but I have been back and looked at the notices on the airport road and it does say no stopping or dropping off. i am not disputing this, what I a disputing is that I was not the driver mearly the registered keeper. I have given the name and address of the driver, but as yet they have not contacted her! Is it me who has to pay it?

Well, well, well thanks for the bit about the Protection of Freedoms Act. i telephoned APCOA and told them I had already sent details of the driver at the time of the Enforcement Notice and that they were harrassing me and blackmailing me into paying someone elses fine. They have decided to drop this action against me. Lets see if they write to the driver who lives in Spain
