hope you guys can help.. you actually seem to talk sense.. been looking for days!

I bought a car from dealer.. called him first confirmed over phone nothing wrong with the car at all (also stated in his advert, and on his website) travelled 140miles to the car to find a car sales in a field in someones back yard! overlooked it as had office etc, started the car no noises all looked mechanically sound, was what i thought was worrying noise coming from handbrake being released, he told me it was normal car had been parked up for a while (being a woman i thought ok fair enough) guy had brand new range rovers etc thought maybe this was a part ex.

Anyway was told the car had a 21point safety check done by mechanic and all paperwork was included. bought car some card some cash. given small piece of paper with scribble on it as reciept. on getting home the handbrake made same noise. used car 2 days later same noise. 7 days later same noise. 8 days later on motorway handbrake engaged doing 70 wouldnt release.

recovered by aa towed home. took to garage had diagnostic was told several cables had snapped all electrics were faulty cam sensor had gone aircon broke etc etc etc. paid 2350 for car told it would cost minimum of 1500 to repair. contacted him he started laughin at me and i dont want to repeat the language he used but i was told i wouldnt get a penny he will get the best lawyers blah blah. asked him for proof of 21 point safety check (it wasnt included and the name of the mechanic who did the check - he refused saying its none of my business!

sent him a letter contacted trading standards. recieved an unprofessional letter saying i didnt contact him within 14days (i have proof i did by email phone and letter) he also said it was fine when i left and all of this can brake through neglect (not sure how i couldof snapped handbrake cables doing 70 on the motorway im not that stupid! also when the diagnostic was done it showed car was scanned 4 times in april showing the same faults.

i bought the car 13th april an i know it wasnt me so obviously he knew about the faults and watched me drive away with my children?! want to persue it through small claims but not sure how i would fair out as because of this scam artist im skint! the car has now been declared unroadworthy and he wont repair/refund help! contacted trading standards they cant seem to find a fixed address for him.. there are several websites on the internet saying to beware of him he sells dangerous cars.. just wish i had read them before :(

Hi ,
The main issue here is that the dealer is entirely responsible for repairs to your vehicle.

Your problem is getting him to do the repairs or to pay for them ,he doesn't seem to be willing to do repairs voluntarily .Your main recourse is the small claims court which will cost you about £200 to process .

It's a simple process ,you need a cost estimate and details of the repairs to your car ,you will also need the car dealers details ,his name ,address ,and trading name .Did he issue a receipt ?

You also say in your post that you paid partly by card ,you should contact your card provider ,tell them the condition of your car ,and ask if they can recover that part of your money for you . Generally it's a credit card company that will help recover your money ,however I believe that under certain circumstances ,it's possible to recover payments when a debit card has been used .

Can you tell the forum who the dealer is and where they are located .

Do let the forum know how you go ,members are always willing to help ,can you also say how old the car was , how many miles did it show ,did it have a new mot .

If you paid more than £100 on your card as a part payment for the cost of the car, the credit card company could be responsible for refunding you for the WHOLE amount of the purchase cost of the car. This is known as section 75 of the consumer credit act.

Sorry, Tony, but it's better if Needshelp doesn't tell us who the offending dealer is. From what she says he looks the sort who would dispute her story and seek legal action against us for publishing it.

thats great, i have his address (he trades from a field in his back yard), however he refuses to give me his name. the reciept he gave was a torn piece of paper saying renault scenic £2350 purchased as seen and a scribble for a signature (he gives a different signature on every letter etc) after looking on google he has several different car sales websites.

i have estimates from my local garage also a letter saying how disgusted my mechanic was at the condition of the vehicle and that it should not be used.

thats brilliant about claiming back for my card company, i didnt realise i could do this it would sold the problem really as i could use that money for costs of getting repair done.

i wont give his trade name/address as if it does go to court i dont want it getting messy. however he trades in the birmingham area, so please beware if your purchasing a vehicle from that area as its heartbraking to be in this type of situation!

i also wanted to know if i do have to go to a small claims court will they put the case in a court near me or him or meet halfway?? (theres 140 miles between us)

the car is a renault scenic grand (needed a 7 seater) paid £2350 for it, 55 plate, 80,000 miles, was the cheapest one around, although now i wish i paid a bit more i wouldnt be in this situation :(

i have been searching on the internet all day for more info etc on my case. when i typed in the address of the property i bought the car from i came across something extremely worrying. the man that sold me the car has just been released from prison on double murder one on a child. i am so shocked i cannot stop shaking knowing me and my newborn baby were in a lane in the middle of nowhere with this man 140 miles away from my home. i am devastated. as you can imagine i do not want to get on the wrong side of this man whether he ripped me off or not thats the end of it as far as i am concerned. there was a full picture of the man it keeps sending shivers right through me.

i am so scared its unbelievable i have sent several letters/emails/phonecalls to this man complaining and now he has my address :(

i also reported it to trading standards :(

PLEASE PLEASE PLEASE ANYONE BUYING A CAR FROM THE BIRMINGHAM AREA PLEASE LOOK INTO THE CAR SALES FIRST AND AT LEAST TYPE THEIR DEALER ADDRESS INTO GOOGLE BEFORE GOING TO THE LOCATION.. ITS NO WONDER HE WOULDNT GIVE ME HIS NAME!

If the guy has been convicted of murder ,he's out on license ,murder carries a mandatory life sentence .he can be recalled to prison at any time .you would have to wonder if he's committed a criminal offense in selling a dangerous car .

That would be enough to have him recalled to prison , in addition how did he manage to get access to a credit card machine ? The credit card companies are supposed to vet applications carefully , if he's using someone else's machine ,I'm sure the machines provider will refund your money ,it's a fraudulent transaction .

I know the above is all easy to suggest ,however this lunatic seems to be in a different league from the usual dodgy car dealer ,it's impossible to suggest a way forward ,you're the only person that knows how far you want to pursue the guy .

You still have the car ,perhaps you could part exchange it ,or sell it on e bay or through a local car auction .
