Hiya all,

I bought an 2000 mitusbishi evo 6 for £5700, 2 days ago, which was described as in exellant condition inside and out. from a trader mechanic/ rally driver which was his private car.

only to find out that the front cross member that holds the gearbox and engine in the car, is very badly croaded, in my opnion dangerous to drive.

the car had been stood a couple of months, so had other small issues bonnet catch needed oiling to work properly, reversing lights not working and fog light not working, these things are minor and i could cope with them and easily fix them.

i have spoke to the seller, who said he would provide a cross member which we agreed, then on further inspection of the car, i have found the AYC pump and tank missing, to which i called the seller again quite upset at this point and asked for a full refund, which he replied he wanted to keep £1000 for inconvience and paper work that had already been transferred.

To which i declined the offer and said i would speak to a solicitor.

Could anyone give some advise please

You already know the solution. A 'Private' sale does not have the same protection as bought from the trade. Will depend on what he promised you or in any advert. Also a 12 yr old vehicle will have faults that the buyer should have made a thorough inspection of.

Sec 75 RTA 88 Sale of vehicle in unroadworthy condition does not seem to apply as cross members are not specifically mentionad as parts not to be defective.

The selling stated in the advert the vehicle was in excellant condtion inside and out, and didnt mention about the AYC missing, coming from a mechanic and a person who also rallys another Mitsubishi Evo 6, i expected it to be roadworth after going through an MOT a few months ago

the fact that you were given the opportunity to inspect it then noticed a number of faults which you were OK with is likely to mean that a court would determine the wording was irrelevent since you had chosen to buy it knowing it wasn't in excelent condition

What is

a trader mechanic/ rally driver?

The mechanic / rally driver bit is irrelevnt (except to presume the car had been sh**ged so why would you buy it?); howver the "trader" bit is the important word.

Does this guy regularly buy & sell cars? If so he is a trader & you can justifiably claim you have bought from a retailer in which case Sale Of Goods Act applies. As such if the goods are faulty (except as pointed out at time of purchase) then you can ask for a full refund. Unfortunately you may have to go to court to get it
