Hi im after some advive please.

I parked my motorbike on the side of the road in a safe place behind a large van when i came back it was lay on its side it was quite clear the driver of the van had reversed into it and driven away failing to leave any details i have reported it to the police but they dont seem interested i have managed to trace the driver myself and the evidence is quite clear he was responsible i have tryd to report it to the police again but they wont get involved wot are my options?

The Police have to take action as the driver has committed an offence of failing to stop.

If you have traced the driver name then he is responsible for your damage and you could demand the cost of damage from him. Assuming he does not pay and refuses to involve his Insurance company & damage is less than £5k then you could issue smalls claims court summons. That should make the driver sit upo and take note.

Just make sure the evidence you have got that he reversed over your bike is as good as possible. you have to prove that on the balance of probilities s/he caused the damage and you didn't just convienently just drop the bike while you were parking it behind the van.

Proving it however is something else.

When you parked behind the van, was it in his blind spot? If so, he probably didn't even know he hit your bike if it was a big van and not a car derived one. Also the tables could be turned as it could be argued you parked where he couldn't see you. I suspect the slightest nudge knocked your bike off its sidestand. Seen if happen to bikes on windy days. Did you leave it in gear to help prevent it from getting knocked off its stand?

As for the police, of course they're not interested as no one got injured. If they were to concentrate their resources on every minor traffic accident, then they'd have even less time to go catch criminals than they do now.
