Hello Everyone, just posted this on Legal for LucyBC to comment. Proposed new legislation will remove the protection under civil law we all now enjoy against the private parking parasites. Our own Government intend to remove this protection and replace it with new laws, under which the private parking parasites will be able to pursue the registered keeper and force them to reveal the driver, or face the fine themselves. Yes, that's right, our own Government is going to allow these vultures to harrass and persecute it's own citizens. Unbelievable, but true. The other slap in the face is the title, it will be called ' The Protection of Freedoms Bill'. Whose freedom? Ours or the vultures who see us motorists as a cash cow to be milked? There are 30 million motorist, most of whom are voters, surely we can exert some power and have this bill stopped in its' tracks. I am a technical novice, e mail and a bit net surfing are about my limits, so I am not capable of setting up a website to orchestrate a resistance campaign, but I am willing to assist in any way I can if anyone can help. We motorists contribute immense amounts of money to the economy, so much in fact that even a small reduction could prove disastrous for the Goverment. United we could achieve that and get this blatant, unfair situation resolved in our favour for a change. Time for the dog to wag the tail instead of the other way around. Cheers Concrete

From what I read, the requirements which have to be met by the enforcing company before the charges can be claimed are fairly onerous. Rather than an attack on your basic rights, more a case of balancing the interests of the two parties in a reasonable and efficient manner. You park or allow someone to park your car on a private parking space and do not observe the reguations, you will pay.

I have private space which people think they can park on without permission, police wont do anything as its not on the public highway. Anything to make it easier to get rid of such morons is very helpful.

Hello Bonzo Dog, would you really wish to give enforcement powers to private parking companies? I wouldn't trust them with the formula for common salt never mind to be fair and just. They exist for one reason only: to generate profit. The only way to do that is to pursue each and every minor breach with a demand for disproportionate amounts of money compared to the 'offence'. What do you think is going to happen if a company whose sole aim is to generate profit, gets the power to enforce the 'fines' they impose? Would you be comfortable with these companies having the power to demand from you, the registered vehicle keeper, the name of the driver? Also if you refuse to provide that, then you automatically have the 'fine' imposed on you. Talk about a win-win for private parking. These companies do not want this power beacuse they are nice people who wish to uphold the law and mete out justice, they want it because it will multiply their income to the power of ten. We will sleep walk into this and it will be too late to resist once it is all in place. Motorists equal money, money equals profit, profit is the lifeblood of private parking companies. Personally I would levy a charge on every car parking space, which is refundable under certain circumstances. Not difficult to set up or administer and of course no need for private parking companies. I am willing to pay a fair price for parking. I am not willing to be subjected to the dubious intentions of companies who see my car as potential source of income. I hope this explains my position more clearly. Regards Concrete. PS I am not talking about small pieces of land, near town centre where people park willy nilly. I don't do it and I don't condone it. I also feel sorry for Jamie, whose drive is regularly blocked. I am sure these situations could be sorted with some thought.

Hi again Concrete, unless I'm reading the proposed changes incorrectly, no powers of "enforcement" are being given to anyone.

Firstly the govt is outlawing private wheel-clamping; I'm sure this is something you approve of (the outlawing, that is)

If someone parks on private land where they do not have entitlement to park (or breach the terms on land where they have been allowed to park) the owner of the land can request that the driver pays a fee. Whether this "fee" will be upheld by court I am unsure (informed views, please?).

Currently if the driver does not pay, the owner (or his agent - the parking co) can request of the registered keeper the name of the driver - which they do not have to give. The proposals would make the registered keeper liable for the "fee" thus ensuring that someone takes responsibility for parking without permission.

If the outcome is to reduce people parking their cars on private land without permission, then I'm all for it.

How do you propose we should deal with the problem of selfish drivers who seem to believe they have the right to park on any empty piece of land they find, regardless of who might own it

The only other solution to it is wheel clamping, which causes so much controversy with unregulated companies and moaning public etc that we cant do that either.

So what are we supposed to do?

Personally i think we should be allowed to set fire to any car on our private land and dump the ashes in the forest. Few weeks of that and people will stop doing it.

Looked into that before, its not practical to do for several reasons.
