Road Traffice Accident - Nelvyn

Last week, a pedestrian walked out in front of my van, there was nothing that I could do to prevent hitting him. I was doing about 20 in a 30mph zone. Fortuneately for the pedestrian there was an off duty ploiceman, a nurse and two first responders all on their way to work who were able to offer immediate assistance.

The problem that i have is that my vehicle was taken away for forensic examination and has been impounded for the last 5 days.

I use my van for my work and I have now lost 5 days of work and been landed with a recovery charge for my vehicle. All of this through absolutely no fault of my own. Has anybody any idea of my rights and can I recover any of my losses from the pedestrian who was fully at fault?

He / she is liable - getting the ££s is another story.

His / her house insurance has 3rd party liability but I am unsure if this covers jay walking and causing your problem.

Assumes she/ he has house insurance policy.

You need to press the police to return the vehicle.

As Falkirk Bairn says the damage is potenitally recoverable if the pedestrian can be shown to be at fault but extremely difficult to recover.
