Hello all
In September i had a very minor car incident on a country land in
Cornwall. Narrow road my car and another had a little squeeze and
there was a little damage to both vehicles.
2 insurance adjusters came out to see my car and view the damage....
that was over 4 weeks ago and i had heard nothing. I was working in
Dublin for that period and thus did not need my car. However on my
return i called the insurance company to see why i had had no contact
from them and why my car had not been taken away for the work to be
done.
I was told my insurance had been suspended because they discovered i
had modified the vehicle without telling them and therefore my
insurance is invalid! i have a Rav 4 which has tinted windows in the
rear... it came like this 2nd hand from a dealer. Apparently the
windows are not standard i didnt know that and that if i had informed them at the time
of insuring that i had tinted windows they would have not insured me.
I find this a bit ridiculous to say the least and am at a loss as to
what to do.
I genuinely did not mislead them and had no knowledge that this was in
fact a "modification"! I have had an insurance claim and bodywork
done on the same vehicle by a different insurer in the past and this
was never mentioned or an issue? Are they just trying to wriggle out
of the claim? Who should i talk to? Any advice much needed and
gratefully received!!

about 8 years ago I owned a black ford puma, and had the windows tinted. All legally and above board. no "limo - drug dealer tints" only after getting it done did i ask the insurance company....oppps wish i hadn't had the tints fitted....5% loading on my premium.

but heard other people say in the past say that if you are unaware of the "modifications" the insurance will often still pay out, you just have to plee that you where unaware of the mod. I've heard of one chap buying a pug 106 with alloys fitted. proper pug wheels to be told after a prang that they weren't standard on his model and they refused to pay out. He really didn't know about them not being standard as they were a pretty normal size wheel and not something that you'd usually see on a Saxo outside halfords..they paid out in the end.....but as you can imagine had to delare the modification from then on. and promply sold the wheels and bought steel ones...all via ebay...the wheels loaded his premium by £75.....

Have the accident adjusters assumed the accident is 50:50?

I would be very surprised if had they known of the tinted windows your insurer would have refused cover and we can test that.

My guess is that you may be liable for the increased cover costs had you declared the tints but otherwise the Ombudsman will rule in your favour and your claim will succeed.

Well my insurers on the phone said the accident sounded like " a classic" 50/50 claim.

Im going to change insurers regardless of the outcome as i think this is ridiculous.

They have categorically said twice that they would not have covered me if they had known about the tinted windows. The windows are in the rear passenger section, not even the rear window and they are not super dark but just blue same colour as the car. i thought it was a standard with the top of the range car.
