2002 bmw 316ti - falsely stamped service book - liam jackson

Hi all this is my first post on here. If anyone can advise me great.

I have bought a fsh 2002 bmw 316ti. The seller claimed it had full service history, i checked the book and it doe's. Now i have started finding way to many problems with the car so i have gone to the garage who has compleated the last three service's over the last 25 thousand miles. Only to find out that they have NO RECORD of servicing the car on there database at all. And they advised me that maybe it was done though one of there employees as a back door job privatley. But it has 3 dealership stamps in the book. So they carn't tell me what they have done and on what date over 3 different services. But its still stamped. Surley this is fraud . Any advice is appreciated

.....so how do you prove that an 'employee' hasn't been doing a bit of moonlighting, done the service and to get his 'dosh' has used firms stamp.? Much not reported as to what was said at point of sale and by whom to whom.

If it were me I should have a session with Trading Standards.

From a dealer or a private sale? Trading standards anyway, probably. A franchised BMW dealer has a lot to worry about if something like this has happened, either thru ignorance or deliberately.

cheers guys im gonna go to trading standards. It was a private sale by the way but he advertised it as full service history with the last 3 services stamped in my book at a local dealership to me. When i called in to the dealership. I discoverd they have no record at all of the car on their system. Which i find odd and i think the problems the car has would have been avoided had it had these services. And it was not a bmw dealership either

From my experience TS will have no interest in this. They only show interest when its a trader and its a clear breach of a requirement or law. And even then its down to the individual to actually sort it out.

This shows the importance of loking at the receipts rather than the stamps.

Sorry to say this but this is what you will find.

If this was me I would make an appointment with the dealer principle and show him that someone is using his company name inappropriately. Not sure what you would end up with but that at least is a positive move.

I'm afraid you are not going to get much satisfaction - I suspect ......

...... UNLESS the service history that did not take place occurred within the ownership of the person you bought it from ie he knowlingly mis-described the car when he advertised it (he did advertise it as FSH didn't he, & you have a copy of the advert? or did he simply tell you this verbally?). If it did, I think small claims would be the best; but Lucy knows better.

Secondly, why oh why do customers take a stamp on a service book as proof of FSH. Did you never read "The Day Of The Jackel"? If there is no invoice asume there is no FSH

It looks like a private sale in which case you have little recourse.

As mentioned above it is worth talking to the dealer regarding the use of the stamps but you have no recourse against them.

There is a potential fraud case against the vendor - the charge being "obtaining a pecuniary advantage" because you would argue that you would not have paid for the car without the stamps which you would argue were fraudulent - but you might struggle to interest the police in such a case.

Worth a go though.

Sect 16 Theft Act 1968 was replaced with Section 2 Fraud Act 2006 and the offence would appear to be 'false representation' ?
