i was involved in a RTA on the 02/2009 where TP car pulled out from side road and hit the passenger side of my car. i was travelling straigh on the road with traffic behind me and in front. the road conditions were icy and and wet

the van drive who was driving behind me seen the accident and kindly handed his details to me to be a witness to the incident.

at the time of the accident the TP admitted liability.

because the TP insurance FORTIS!!!! who were taking for ever to respond to the claim i had no choice but to go through my own insurance Zurich!!!

Unfortunatly my own Insurance was voided because i did not declare Points on my licence which were cleared prior to the accident and prior to my taking up the insurance with Zurich. (Any excuse for insurers to avoid paying out).

this left me no choice but to wait for the TP insurance Fortis to respond.

its now been over a year and stlll my solicitor is kept being told they are investigating.

I am really losing hope on my solicitor as i believe he should be doing more to push them for a response..

Please help me and advise what i can do..... I have no idea where to go :-(((((((

Am not sure if i should hand the case to another solicitor or if i should go nocking on the TP home.

Make a claim through the courts "small claims", my understanding is that the insurer has to defend their client, therefore will need to do something about the claim, if it's not huge, they are inclined to pay out rapidly.......I have had this experience, wheer I received payment within a few weeks of submitting a claim.

Don't forget to add in your costs for writing letters, phone calls, loss of use of vehicle etc.
