Hi I was recently in a non fault RTA 10/05/2010 the police crash investigation unit contacted me yesterday looking into the incident and the officer advised that my Full uk licence was refused/revoked in 2002! I am completely unaware of this and am now scheduled to be interviewed under caution on Monday 07/06/2010. I immediately spoke to DVLA and they stated it had been revoked due to a medical assessment apointment i failed to attend following an RTA in 2000. I have never recieved any notice to attend an assesment or indeed notice of revocation and for the last 8 years been oblivious to this!
Where do I stand ?please help this is making sick with worry. Thank you.

The details would have been served on you at the address the DVLA had for you at the time of the accident so at some stage between 2000 and 2002 your details on your driving licence would have been incorrect.

In itself that is no defence as you are supposed to keep your licence up to date and if the notice they served is on the address they had for you that will suffice in legal terms.

You have been an unlicenced driver from the time the notice was served.

You need immediate expert legal assistance with this today.

OMFG !!!!!!! Sorry for the language but I'm in Shock DVLA have admitted an error and re-instated my Full Licence!!!!!!!!!!!!!!

Firstly thank you for the speedy response it came as i was in disscussion with DVLA.

Let me give a little more background as in my haste to seek advice i was a little short on the info given. Basically, in July 2000 i was involved in an RTA sadly to this day i have no recollection of what happened, so i was admitted through A&E for test's and ob's, after all kinds of test Biochemistry/EEG/CBT etc they stated all the test's came back normal and i quote they 'advised me i did not need to inform DVLA of any diagnosed medical conditons'.

That for me was the end of it, however, DVLA decided in their wisdom i needed medically assessing even though a plethora of test's said i was ok.

In the December 2000 I moved.

After settling into our new home, i did the usual letting everyone know that we had not already advised Including sending my licence to DVLA for an address change, this was duly done and I got my licence back with my new address on it date 06/06/2001.

Unfortunately, the clowns at DVLA forgot to check this and continued to send Medical assessment request's to my old address. The Consultant was even sending letters to the wrong address and to my doctors, all of whom had my correct address.

Subsequently, the consultant they wanted me to see, advised DVLA I had failed to attend these assessment's (of course i didn't, I didn't get the b***** letters so how could i go)?

So as a result of this the DVLA revoked/refused my Licence 04/11/2002.

I was oblivious to this, as of course even though they had the correct address as per the licence they updated and sent to me they continued to write to me about revoking my licence to the wrong address. A total of 4 times alegedly

Around 2004-05 i got stopped on one of these petty DOT vehicle checks as my car was clean the PC was p'eed off so gave me a Producer which i duly obliged went to my local cop shop and handed over my Doc's, guess what? nothing said about it being revoked then either (some check they do eh?)

January 2006 stupidly get a Fixed penalty SP30 so again, as a good lad, sends off my Licence to get my 3 Points and graciuosly pay £60 for the privelage again no mention back saying licence revoked! I appreciate the court endorse your Licence but the information ends up with DVLA so the national database is up to date ready for the next time, how else would they get you on totting up if DVLA wasn't informed?

Present year 10/05/2010 non fault accident TP emerged from side road straight across my path Boom! car fully loaded with my kids and partner who i just picked up from swimming, ambulance and dibble attend, wife and two kids go to Hospital. At the roadside I gave the dibble my Licence so he can write down my details and do check if he wants as one would assume they would do, again nothing.

This week 2/06/2010 crash investigating officer phones me about independant witness' and then drops the bomb according to his sytem my licence was revoked/refused in 2002! you can imagine what i said and felt.

So gets on Phone to DVLA and they confirm story as above as i failed to attend an assessment they revoked/refused my Licence advised i would need to complete a s*** load of forms and re-apply! i explained I had recieved nothing abouth this but just got the deaf ear they sent the letters therfore i MUST have had them even though one would expect such an important piece of information as this should be sent registered, oh no they just pop it out second class!!!!!!!!!!!!

So dibble phones me and kindly makes an appointment for this Monday 7/06/2010 to 'take a statement from me about this' under caution of course cos basically there gonna screw me to the floor Driving with no licence/ invalid insurance.

So to cut this down as i feel it's getting too long winded I phones DVLA again today speaks to the manager whom I spoke to yesterday and he admit's they made an error in 2001 when they changed my address they didn't tell the medical assessment bods then again niether did the medical bods notice this all the time they are in the process of preparing to make my life hell!!!

Then the killer punch even with this under their noses some department still is adamant i need to re-apply even though they FUBARED the whole job! thankfully the manager I had been speaking to argued the toss and won so now my licence is re-instated with no record of being revoked/refused.

My next question is how do i take the Bar-stewards to court for the damage and stress they caused me? all be it a few days it's been hell i havent eaten/slept been so depressed contemplating the thought I'm going to lose my job (I need a car as part of my job) who would employ me after this I'm an Insurance underwriter! and my family and home along with prison and huge fines etc.

I feel physically sick that an error of this magnitude can have such a devastating effect to an individual and they didn't even say sorry!

I feel strongly that for myself and many other individuals who have and will suffer as a result of this high level of ineptitude, they must be made accountable for their actions.

It's very unusual for the DVLA to back down on anything. Normally these cases go through due process.

You would have won in court but it is fortuitous (and an incredible long shot) that you found someone in the DVLA in a position of responsibility who was prepared to make an intelligent decision.

I feel sorry for the stress you have clearly suffered. However as to the matter of compensation I wouldn't recommend you bring a case on the DVLA issue. Cases like this would be rigorously opposed on principle and it would be a costly case to bring, offering additional stress and uncertain prospects for success at the end of it.

On the 10/05/2010 accident can you explain where you are? Is this all being dealt with satisfactorily?
