Hi. I'm not good with this kind of thing so please bear with me :-)

My credit card provider has upheld a section 75 case, and is refunding for a car purchase.

The car will be collected by an auctioneer company in a couple of weeks time.

I have been instructed by the credit card company to send the V5C in full to the auctioneers (not them) and to complete the yellow section 'Selling, transfering, or part exchanging to a motor trader'

It asks for date of sale in that section though (mandatory question) Should I just write today's date?

Another option in the letter is to complete the same with DVLA online, but again they want a date of sale.

I'd call the credit card company and ask on Monday, but they are a nightmare to get through to, then you have to request a callback which comes a few days later.

'Sale' is a misnomer, it is actually the date of transfer of registered keeper.

In this context it is therefore the day the car is handed over to the auction and is then no longer your responsibility, so enter the date it is collected.

Once the car is collected you could also do the change online.

Take lots of photos too to record the condition prior to pick up.

I'm glad you've said this as it's what had me confused. I'll have to call the CC company then, as it states in their letter NOT to give the V5C to whoever collects the car on behalf of the auctioneers, just in case it gets lost.

I don't even know when the collection date will be, and apparently they come out with little notice. Adding on top of that, they won't come out until they have the V5C, so I'm stuck to go forward :-(

If the credit card company is refunding you, then presumably they are taking this money from the dealer you purchased the car from.

If this is the case, should the car be returned to the dealer instead of going to auction?

Hello. No it went past the timescale for the car dealer to be the one to refund, so the credit card company are refunding me (and shortly after the car is collected)

My dad rejected a car a good number of years back. The amount of hassle and stress it caused was unreal. You do have my sympathy over this.

I get it in a way, as they shouldn't take a vehicle without the document, but I can't fill in the V5C with a date either, as I don't even know when they are coming to collect - I've only been advised they'll call to arrange when they have the log book.

I then receive the CC refund once the car is with the auctioneer (it'll be salvaged once there)

Fill in the paperwork and leave the date blank. Photograph it for your records then send it to the auctioneers by REGISTERED post. That way they have to sign that they have received it and you get a record of that. As said above take lots of photos of all parts of the car inside and out so you can prove what condition it was in when it left you. You need a paper trail as evidence that you have done the right thing throughout so do everything in writing and keep it for several years. If you phone anyone get their name and write it down along with what was said, date and time.

I would:

Take photos of all pages of the V5C, ensuring all reference numbers are completely legible. Then post it to the auction company by a tracked postage method.

Goto www.gov.uk/sold-bought-vehicle and transfer ownership online, as soon as the vehicle is collected from your address. Use the following answers to the online questions.

1. Are you a motor trader? Answer: No.

2. What have you done with your vehicle? Answer: Sold it.

3. Did you sell the vehicle privately, or to a motor trader? Answer: Sold it to a motor trader

You then get a page with this on it:

"Tell DVLA you've sold, transferred or bought a vehicle Sold your vehicle into the motor trade

You need the 11 digit reference number from the latest vehicle log book (V5C).

  1. Give the log book to the buyer, including the green ‘new keeper’ slip.

  2. Tell DVLA you’ve sold the vehicle using this service.

  3. Destroy the yellow ‘sell, transfer or part-exchange your vehicle to the motor trade’ section from the log book."

Doing the above transfers the vehicle to the motor trade, so you are no longer responsible for it (for speeding fines etc). Hope this helps.
