Hi I put a deposit down with a credit card, went see the car but the brake disc were very corroded and they said it had full service history, but it was missing a service. They said they will check the brakes before I collect the car and give me a new MOT, i took pictures and showed to a mechanic and he said that should be changed. Also I checked the MOT online when I got home as they did not have it to hand, and it had the brakes, headlight and wiper as advisory's, so clearly they were aware of the cars issues. Although I signed a receipt for my £200 deposit, they did say they would check the brakes before delivery, but after the MOT check i don't trust them, do you think i have the right to ask for my deposit back?

Why did you put a deposit on a car you're not happy with?

Providing it's not a none refundable deposit, i think you should get your money back and go elsewhere.

They may be kind and refund the deposit, but a deposit is really a token of good faith on your part that you will proceed with the purchase. It seems the car has passed the MoT (those faults are only advisories) so you should ask the seller nicely to rectify them and carry out the 'missing' service before you collect.

If you back out, the seller is within his rights to keep the deposit, unless you can show that the car is unroadworthy in some way. Simply not trusting the seller is not an adequate reason (plenty of car traders are 'not to be trusted', it's a fact of life).

It sounds like you put the deposit down before you saw the car by the way you have written it. This is not a wise thing to do.

However, If you used a credit card to pay the deposit then you could ask the credit card company to refund you under section 75.

If you paid the deposit before seeing the car, did the salesman tell you the car had missed a service etc? If not you might have an angle there. I'd never put a deposit down before seeing the merchandise.

As Andrew-T has said, the MOT advisories are not anything unusual for a used car to have. If the brake discs are excessively corroded then it should have failed the MOT.

If the car is not as described then surely legally you are entitled to the money back. However they could still refuse leaving you with the bother of a small court claim. Unless as above you can get it back from your credit card. I hope you can sort something out amicably without legal action.

Surely it all depends on the nature of the deposit - non-refundable or refundable.

I put a refundable deposit of £500 for a car to be brought from another Mercedes dealership branch. The car did not meet my expectations and deposit was refunded with no problem.

It is perfectly understandable that OP left a deposit as a sign of intention to buy. If he no longer wishes to buy then the contract may well be frustrated.

As previously posted - hopefully it can be sorted out amicably; things often are with clear and courteous communication.
