I have a had the above car for a week and the fly wheel is faulty took it back to the dealership as instructed to do so by him to investigate.His mechanic told him it need a new fly wheel , on hearing this he started to back track and said it might not be covered. At the time of purchase he never mentioned what was covered and what is not.I have no paperwork for this warranty I only have verbal assurance where do I stand on this issue is it covered under the sale of goods act. Has anyone had the same issue regarding the warranty and what was the out come.

It seems the OP has had the car for such a short time that there should be no question that legally the fault would be regarded as pre-existent and therefore the dealer's responsiblity.

The OP should forget the "verbal warranty" - it's worthless and irrelevant. He is covered by SOGA anyway.

I suggest he presses the dealer for the replacement of the flywheel and quotes the Sale of Goods Act 1979.

The OP is to be congratulated on dealing with issue in a timely fashion and not letting it drag on before reporting it.

Thanks for the reply, I have been liasing with the dealer he seems relunctant to fix it. I have to call him after the bank holiday, if the out come is negative I will quote the sale of goods act 1979. I will post again the out come.

He's stalling for time, hoping you'll get fed up and go away. I suspect he'll give you the run-a-round until you get him in court and even then he may well not cough up for the repairs.

I hope I'm wrong, for your sake, but if you come down hard on him now it may concentrate his mind.

Depends on how many miles the car has done really. Low miles, you have a very good case. High mileage, and it is getting on shakey ground.

SoGA excludes fair wear and tear so if it has done the sort of mileage where a flywheel would be at or near end of life you have a lesser case and the best you might expect is a contribution towards a new one.
