I believe that a 10% over leeway is allowed when speed is checked by the usual speed cameras. Thus a 50mph limit is in fact 55.

Is this still the case when the cameras on smart motorways are used? Does anyone know for certain?

No. Is the short answer. I see lots of flashes when the overhead cameras are active, but it is impossible to estimate the speed of the vehicles involved. If the gantry signs show the cameras are active then why take a chance? Does the difference of 55 to 50 mph for a short distance effect your journey? Probably not, so play the conservative card and observe the posted limit as you see fit. You pays your money.........

Leeway may well be allowed - there is ACPO guidance - but it's not a right. 51mph in a 50 zone is a criminal offence and you could be prosecuted for it. Stay within the limit and stay with a clean licence!

Up to 10% + 2 is discretionary, but they can do you for 31mph in a 30mph zone. Plenty of drivers are indeed getting done for 32mph in a 30mph zone, usually a speed awareness course for a first offence. I am surprised you can get up to the limit, where is this magical motorway? :)

With modern digital cameras which don't run out of film the speed can be programmed to 1mph above the limit and thousands of tickets churned out. However every ticket still needs human intervention at some point which isn't available so a 'buffer' is required to ensure the workload is manageable.

Leif - I found the magical motorways yesterday. 230 miles on M4, M5, M42 and M1 in 4 hours (including a break) without going anywhere near warp factor speeds and this included the 20-25 miles of the M1 where there are currently 50mph limits.

Traffic was inevitably lighter than usual, but the roads were far from empty. However there were far fewer HGVs around, which on the dualled A42 makes a huge difference, even with the "no HGV overtaking" section.

Today received a speed fine for a car i sold a month ago. Anyway on the form it suggested the speeds that would attract a tick if hey were 10%+2mph (no worded they way be what they meant). So in a 30 if you have 35mph and upward you are at risk.
