Toyota Auris - Part Exchange Vehicle - False MOT and Service - jazzyman

I purchased a Toyota Auris around three weeks ago which came with a full dealer service history. The vehicle had just received a full service (book stamped) and a new MOT carried out by the main Toyota Dealer.

Because of the full service history and fresh MOT I was not to concerned about if the vehicle had any mechanical issues. The service and MOT was carried out by the main dealer when they were in possesion of the car, it was a part exchange vehicle.

The car has only done 300 miles since the MOT/Service and a noise is now coming from the brakes, the brake discs are badly worn out and also the brake pads. I checked back on the vehicle's MOT history (online) and I was alarmed to find out that worn brake disks had been reported on advisories since 2012, the latest MOT had no advisories. I now have my doubts if the main dealer carried out a service, because the problems of the brakes should have been picked up.

I have contacted the main dealer to see if a fresh MOT and Service (including fixing the brakes) could be carried out free of charge, no reply yet and I dont suppose they will reply. It is worrying that a main dealer garage can carry out this type of practice, should I report the complaint to VOSA? or any other advice would be very much appreciated?

This should have been spotted and corrected as part of the service.

I would be going to the Garage and politley suggest that they change brake pads and discs at their own expense.

If they don't cough, then a visit to Trading Standards

Draw the dealers attention to Section X1175 Road Traffic Act 1988::

Issue of false documents.

If a person issues—

(a)any such document as is referred to in section 174(5)(a) or (b) of this Act, or

(b)a test certificate or certificate of conformity (within the meaning of Part II of this Act),

and the document or certificate so issued is to his knowledge false in a material particular, he is guilty of an offence.

Problem is the advisory was an an opinion as to the danger in the future and to be abosutyely sure you need evidence as to the condition when actual test carried out. .

The people as you mention are VOSA who can opine and if necesssry take steps to remove authority to Test.

Brakes just need to work for an MOT and meet a minimum standard. If they do that, it passes.They will only fail on worn discs if, in the opinion of the tester, they are worn to be in danger of cracking. They need to be completely worn to do that. Pads need to have a very, very low minimum thickness to pass and in most cases you can't see them anyway so the tester has to give the benefit of the doubt.

Advisories are very much at the discretion of the tester - some advise everything and some only do so if dangerous.

There is nothing you have posted which suggests the brakes are dangerous, just a bit worn out and noisy.

They probably should have been picked up at a service so ask them nicely if they will replace them but I can't see it is a VOSA issue.

A lot comes down to what is considered a "service". It can just be an oil change and not a lot else.

I received a reply back from the main dealer, which stated that the mot was carried out under the vosa guidelines and that the correct procedures were carried out and that there is no comeback.

However, what was worrying is that the dealer stated that they had the full history of the vehicle and there were a number of issues with the car that were discovered with the MOT /Service, because of these issues the last owner decided to get rid of the car and part exchange the vehicle with a new Auris.

The main dealer would not disclose what the issues were. Is the main dealer or Toyota obliged to give out information regading the car's history?

You could always write to the previous owner, Its on the log book.

With a self address envelope, hopefully he may get back to you with his reasons why he got rid.

Not sure about the dealer giving details out tho.

yes I have drafted a letter to the previous owner, just hope that he is helpful. The previous owners information is now not on the log books, luckily the dealer who sold me the car provided me with a photocopy of the old log book which had the owner's name and address.

As a buyer, A salesman is your best friend.

As a customer looking for repairs/warranty work/or to make complaints, They are as helpful as a fert in an elevator!

I remember years ago, My dad looked at this car at a large showroom, he asked to see the log book and made a note of the owners details and in the documents found his phone number.

Once at home my dad rung the previous owner and asked him basic questions.

All in all he was helpful and did buy the car in the end.

There is no harm in asking questions before parting with your hard earned cash!

As you have the current MoT document you can use the DVLA website to look at all previous MoT test results including advisories.

I have checked the current MOT online and there are no advisories. The vehicle has always been tested by the same main dealer garage since new. The previous two years of MOT's had advisories regarding worn brake discs. The brakes still havent been changed and are now probably worse than the previous years. The car was mot tested and serviced and then sold to a trade auction straight after the service and mot, so it's all very strange?

I have had MOT's and issues have been pointed out that next years didn't it just says something about the MOT system.

A service could just be a Oil and filter change and nothing more. So the dealer my well be correct about the facts provided.

If I read it right all that is wrong is possibly some worn pads and discs. These always wear at some point.

If it is OK otherwise bung some new pads and discs on it and get on driving it. Annoying maybe, but not the end of the world.

With regards to MOT advisories.

Dads car was MOT'd 2 years ago, on the certificate the garage advised that the front tyres were barely legal. I had checked them before the MOT and they were fine, had 3mm left across the whole tyre. Shortly after changed fronts and rears round, the fronts now had 4 mm, the rears 3mm. At last years MOT both front and rears had 3mm and guess what, no advisory. They will be changed before this years MOT, 2 years after the advisory and still legal.

I got an advisory on my car about 6 years ago. Stated that the Hazard switch was illuminated when the lights were on. Strange but that is what is supposed to happen, helps you find it in the dark. Once activated it flashes. Tester would not have it, said to get it fixed. The next year, same garage, different tester, no comment. 5 years later original tester again and he commented about the switch but did not put on as advisory. Total idiot.
