I was driving my van with an overload and was stopped by police. Police weighed the vehicle and found that I was above the weight limit by 26%. The police also identified a fault in the brake pedal and their was noise with the steering. I received a letter today and they have said I will be receiving 9 points on my license. 3 points for each of the incidents mentioned before. I feel that 9 points is very steep for one incident and is unfair. are there any legal grounds on which I can defend any of the points on? Thank you for reading.

NO.

Each offence gets points and fine,simple as that.

Plead not guilty, go to court and probably get a bigger fine for your trouble since the vehicle was overloaded and found to be defective.

Payup and learn to maintain your vehicle and not overload it.

The overloading is prescriptive- it was weighed and found overweight - fair cop.

Of the other two "something wrong with the brake pedal" and the steering was "noisy"

Could you elaborate? Who inspected it? Was it a police vehicle examiner or just an ordinary officer?

26% over the weight limit is a huge amount - if it's a 3500kg van then the overload is nearly a tonne - even if it's a minivan it's best part of half a tonne. You're lucky that's being dealt with by fixed penalty and not going to court and getting even more points and bigger fine + victim surcharge.

Have things changed?

Last i was aware of the maximum penalty for overloading was a £5000 fine, not aware of penalty points being awarded for this, fully expect the Traffic Commissioners office to take a dim view though, expect to be pulled regularly from now on.

Not sure on the max penalties for the other faults.

Good maintenance and running legal weights is far cheaper than running dodgy, but you now know that.

Sect 64 RTA 1988 breach - overload - in my book does not carry points - unless charege was dangerous vehicle?

Hi Agree with comments, overloading of at least 26% is very serious and carries points and a fine. Plus additional points for other faults found by Police. Plead guilty and move on ... but with legal car.
