Hi.

I received a Conditional Offer of £100/3 points on 14 Jan 2014. I requested and received photos and then replied that we could not be sure of the driver, but also challenged the ay the reading was obtained. I received an acknowledgement on Fri 7 Feb, stating that my letter was "receiving attention". I have heard nothing since and the 28 days for response expire tomorrow on Feb 12th.

Do I still have to respond tomorrow, accepting either the offer or electing court, or should I await further contact follwing their letter of 7 Feb?

When you received ther initial paperwork was there not a request under S 172 RTA 88 to name the driver? This has to be done and returned within 28 days otherwise they can take the matter to Court as it is an offence not to comply.

In what you state it appears to me that so far you have failed to do so giving them the option to take the matter to Court.

IT could be that they have taken your stance as a "Not Guilty" and are now processing the matter to Court with possible summons for speeding and failing to name driver. The former offence should be a no no as they do not have evidnce as to who the driver was.

In your position and in view of the deadline I would contact the Office concerned and try and ascertain just what they are doing?

On the Court Report summary in our local paper this week there are 2 drivers who have been convicted of "failing to identify a driver". Each got a £600 fine, 6 points, £85 costs and £60 victim surcharge. Hope the actual driver is paying the fines for them.

Well I sent them an email and got a polite reply saying my file was suspended until they had time to consider my case. They did not say when that might be, but I should not worry about the 28 days. So I just wait I guess.

WE can help! However you have already had the opinion of DVD, who is clearly legally qualified or very well informed and probably the best person here to give you an opinion (NOT knocking you Peter BTW) If you want 100% certainty go and see a solicitor, I suggest>

You may have an attitude problem.
It is unclear quite what you have done.
Your original post is full of holes. You say you have received a COFP but then go on to say "that we could not be sure of the driver,
You do not get a COFP until they have received an S.172 ( NIP) unequivically identifying the driver.
But then you also challenged the way the reading was obtained. How was it obtained exactly and why do you think it is wrong.
I would suggest you address these matters as it could all go pear shaped pretty quickly.
You will jump from a NIP to a summons or even Failure to Furnish which is 6 points and a circa £500 fine andan MS90 on your licence that will hike your premium for the next 5 years.
