I would like to share this first to inform the public as much as I can and also maybe someone with similar experience could give some advice.

I bought a BMW 3 coupé (2007) from the Cargiant about six months ago. Although I didn't intend to buy a warranty with it, the sales guy persuaded me vigorously by showing a leaflet saying things such as, this a very transparent high quality warranty governed by the Cargiant safeguarding and it is only administered by the AA and if the car develop any fault, such as engine or transmission or fuel system etc. they will deal with it directly and so on... Now after about six months the car has developed some fault to do with the fuel system and they refuse to pay. The BMW specialist diagnosed the problem and need to change the the fuel injectors, injector coils and also spark plugs. But the AA warranty says that these components are not covered.

I told them when the Cargiant sold me this product they showed me this leaflet, which I still have, and clearly says the warranty includes Engine, Fuel System, Working Materials, etc. Now if you were to exclude various parts and components of the engine, fuel system and so on, then you should have printed them on the warranty description as well. Therefore according to the SOGA this product does not match the description, is not of satisfactory quality and is not fit for purpose, and I request a refund. But they just told me to contact the Cargiant. I did phone the Cargiant and after wasting some time on the phone they told me to write an email to their customer service.

Now this is the greatest misleading product and the most annoying service that I have ever come across in my life. I will surely not let them get away with this because it is pure misleading and waste of time and money. Please share any similar experience and also any advice.

Your first course should be to read the fine print of the warranty agreement you'll have been provided with (not just the leaflet) and this will give you a long list of items excluded and also exclusion of fair wear and tear. See if it specifically mentions or excludes the injectors and injector coils. Forget the spark plugs they'll be a wear and tear item so excluded. The injectors also wear out over time so the warranty company will probably say they haven't actually failed they are wearing out and aren't covered. If your BMW specialist can prove they have completely failed then you stand a chance of some recompense but don't hold your breath.

I think you stand an ever so slightly better chance of throwing it all back at Car Giant if what you say is true and relate to them how you've been missold the warranty. Write down everything you remember about how you were sold it, what was said and who said it. Put this to them in writing to a director by recorded delivery and they without accepting any of your points nevertheless do something for you. Again no holding of the breath.

Other option is that Car Giant have a responsibility under the Sale of Goods Act to make good any fault with the car in the first 6 months so you could check out with the Citizens Advice Bureau exactly what your consumer rights are. You could then approach Car Giant with a view to taking the car back and refunding your money less any reasonable charges such as depreciation. Very difficult and very time consuming to achieve at any time after purchase let alone 6 months but it is an option. Or another similar car to replace your faulty one then they repair yours at their cost.

Warranty companies make profits by paying out as little as they can and have offices full of experts at doing this and fobbing you off. You'd be better off cancelling it, getting as much of your mone back as possible (not easy I acknowledge) and then putting the money you would have spent on warranty aside for situations like this.

If you searched these forums you'll find a lot of people with almost identical stories like yours, "fair wear and tear" popping up everywhere and a paucity of people delighted with the way their warranty claim was handled.

I have written to the Cargiant asking for a refund, I am waiting for a response. They were very sneaky, now that I come to remeber how I was fooled to buy this AA warranty. Because when I was sold the AA warranty, the sales guy lured me into it by showing the warranty leaflet with big prints, no small prints. When I came back to pick the car up few days later, then they gave me the AA warranty contract. Now this is few pages contract with all samll prints and I didn't read all of it right then. However, when some one tells you the warranty covers the car engine you would automatically assume well the car engine includes many components or the same as fuel system. I find it hard to understand how one could justify that the fuel injector is not part of the fuel system.

One thing I understood by discussing this with the the BWM dealer is that the AA warranty never made any significant contribution to the cost and always find a way of dismissing. Also on top of anything else, the service that they provide is absoloutly rubish. Each time I had to waste at least good 20 to 30 min on the phone talking to different people and when they meant to contact me back they never did.

Does your car have a full and up to date BMW service history? Reason I ask, is that I have the same car as you which coincidentally I bought from Car Giant when it was 2 years old. After a few months it started to jerk under gentle acceleration and eventually a yellow engine warning light came on.

I took it to BMW and they diagnosed a faulty injector which they replaced under warranty. Every 3 - 4 weeks after that the same happened with the other cylinders until all 4 were replaced.

Last year, the same happened - jerky acceleration but no warning light - except now I was out of the warranty period with BMW and relying on my AA Warranty I bought from Car Giant.

I did a bit of Googling and found out the BMW are having problems with coil packs fitted to 2.0i 4 cylinder engines on 1 & 3 series cars made around 2007 & 2008 and they were replacing them free of charge. I rang the dealer and asked if my car was covered and it was. Booked it in within 2 days and the job took an hour. Car is back to normal.

For info I have a 320i SE 170ps E92 Coupe with a build date of Dec 2007.

If BMW won't help you then I suggest going into Car Giant and talking to them directly. I have read their aftersales is normally pretty good.

The car has a full service history, it is a 325i, 3.0L engine, 57 reg. The problem was idling rough when the engine was cold and each time the yellow engine light came on. But when the engine warmed up a bit it went away. The BMW dealer has diagnosed the problem as fault with 2 fuel injectors, 2 injector coils and 2 spark plugs. Also they said after replacing this the managemnet software needs to be updated. In total it costs just under £1000.00
