Mazda - 2012 - Used Car - Consumer Rights - how long for a repair? - Warning

I bought a used Mazda 2012 family hatchback with 18k on the clock.

Rang the previous owner for testimonial, who said it was a good car. It had two Mazda services. They had traded it in for a SUV.

When I drove the car home it drove fine, but I could hear a crunching noise when going from 2nd to 3rd gear (it did not happen all the time). I had to 'pause' a tiny while when changing from 2nd to 3rd gear, to avoid this.

I also noticed the brakes were spongy, the braking distance was double. I noticed front and rear brakes had 'hot spots'

Emailed the car dealer. They told me to bring the car, but the earliest appointment was in 10 days time.

After examining the car, the dealer rang me up to I need a new Gearbox, Clutch Kit and release bearing. I have never owned a car where I had to change a gearbox or a clutch!

For two weeks, I have been hearing the parts are on 'order' with their supplier. On Thursday, I was told parts will be there in 3-4 days. Plus, I imagine, they will need a couple of days to fit it to the car.

I appreciate their honesty about the nature of the fault. I dont understand how a car with 18,000 miles can have such issues!

They tell me they will be putting in 'manufacturer approved' parts and come with a 12,000mile or 1 years warantee. But it will not be Mazda dealer parts.

Is there a reason, why they are taking so long?

I still have my old car (up for sale), paying two sets of insurance / tax.

What are my consumer rights? Is there a maximum amount of time, they can take?

I was not happy, they are fitting not fitting original Mazda parts, as I was hoping to buy Mazda warantee. It could scupper my plans, if there are non-Mazda parts in the car. I guess, I would have to buy a warantee from one of the other companies...

It is nearly 4 weeks gone.... I only drove the car from the dealer to my home. And back from my home to the dealer!.

There's something odd here, 18k in 4 years is very low, previous owner verifying car as good but you are finding major defects! I would do a bit more digging of the history of this vehicle.

Elderly driver, not quite 'up to the mark' any more, minimal mileage and lack of mechanical sympathy ?

I'd be just as scared of a very low mileage car as of a very high mileage one.

Yup. Once it goes past 4 weeks, you lose the 'short-term rejection' rights.

So write to them ASAP, informing that you have decided to reject the car under CRA, rather than agree to a repair. You could (your choice) inform them that this is partially due to the length of time it has taken them to source replacement parts.

Send it by first class 'signed for' post. So that they cannot deny receipt.

You will then need to drop off any paperwork, spare keys, etc with them, and they will have a maximum of 14 days to give a full refund.

The CRA is quite clear. You use your rights or you lose them once you go past the times listed.

They said they would cover the cost of the gearbox.... but a bit vague on the brakes.

I can't understand it either. I spoke to the husband, who seemed genuine. He was a bit peeved at the trade-in price, which Audi dealership gave him, but said I got a great car and low mileage. The car was registerested in the wife's name. He is a small business owner and had a company van too.

The issue with the noise going from 2nd to 3rd did not happen all the time. I just assumed it was a minor issue!. I have never had a gearbox problem in my life, so did not realise the seriousness.

It is with a heavy heart I have wrote to them to reject the car. I really like this car, it took ages to find a right one.

When I had asked the car dealer, if they would prefer me to ask for a refund rather then repair, their staff said, I would only get a 'trade-in' price. This is where I lost trust in the car dealer. Because if they were willing to mislead me over my rights, then could they also miselead me about the repairs. For insance put in reconditioned gearbox, instead of a new one (they told me they would not put an original mazda, but an equivalent one). Given that gearbox are expensive repair option, I was not happy about taking the risk.
