This will take a bit to explain so please bear with me.

I purchased my 2012 Fiat Bravo 1.6 multijet with 14k on the clock from a main dealer in Oxfordshire (shan't mention their name now as I'm not sure how that would be accepted here). Took delivery of it on 16th December 2015.

When we test drove it a week earlier we found the car radio didn't work. The salesman said the workshop would sort it out for us. The following day he telephoned to say the radio was totally dead and it would need a new radio which would be done before we took delivery.

We collected the car as stated and the radio apparently worked fully. On our journey home, we live in Coventry so over an hours travel, we found that the radio was going on and off. Initially I thought it's the AF function kicking in so would need a read through the owners manual to disable it.

Over the next few days I worked out how to change the AF setting. It seemed to work as the problem stopped. However it started again and no matter what setting i choose the radio was actually switching off and on again, cycling on and off. It is very intermittent and random, doing it and then going for up to a week without a problem.

Eventually I watched what happens with the radio. It turns off as though the power button has been pushed and will then come back on by itself. If we're lucky when it happens we get 5 to 10 minutes before it repeats or it repeats the cycle every 20 seconds or so at worst.

Between the Christmas and New Year break I contacted the salesman, and reported the problem. After a few calls back and forth one of his colleages called us stating that as I had their warranty, 3 yr extended with their company and run by Car Care Plan, I can should take the car to a local Fiat dealer and have the radio sorted that way.

At this point the radio behaved itself for several weeks but I contacted my local dealer explained the problem and asked if they could do the warranty work. They said they didn't have an account with my dealer and they wouldn't be taking on the problem as my dealer should do it.

I wondered how much the radio would cost to replace so went to see how difficult it would be to remove from the dash. I was surprised as the radio just came straight out of the dash mounting. I found the locking springs were damaged, one had been snapped in fact, leaving the headunit insecure! Also found a big dent in the top of it.

I Googled the part number and came across what looked like my radio with identical marks and serial number on eBay. The sale had ended. I was fairly sure my radio had been bought of eBay after this. I followed this up later with the eBay seller who informed me that they had sold the radio to the same main dealer in Oxfordshire on the day after our test drive!

I contacted the main dealer earlier this week and complained to the general manager, the sales manager was on his day off, about the faulty radio, the fact that someone there had bought a used radio from eBay of all places and fitted it in the car despite it being clearly damaged and unsafe being loose in the dash, and this was very unprofessional!

I also informed them that in my opion this wasn't a warranty matter and they should replaced the radio as they had left it in this state before me purchasing it.

I sent them an email with attachments showing video's of the fault, images of the radio, labels and damage, along with the eBay item number for them to compare. I was told they would expedite this to the sales manager. After a couple of days I had an email from the sales manager appologising to me for having to complain about the faulty radio.

However he is insisting that I need to get the radio replaced under warranty. He has offered a free loan vehicle if I return the car to them. I pointed out I will have to travel expenses of close on 300 miles in all for something that has nothing at all to do with us. I also pointed out that they are responsible for replacement. However he insists that the work must be done under warranty and they will need the Bravo with them for the assessor to examine and for his authorisation as to what sort of remedy he thinks fit, so we may not get a new radio, perhaps even a reconditioned or used one.

I haven't replied to his last email and have been loosing sleep over all this. I haven't made my first repayment on the my warranty and I'm on the point of cancelling the payments via my bank. I'm not sure if a main dealer would have some sort of warranty in place of their own to cover them in these sort of situations or if the sales manager is intending on pushing it through via my warranty.

I would appreciate any thoughts on this and hopefuly some advise from someone on here in the trade as to who should be liable. I don't see why I should be or my warranty used when the dealer is clearly at fault as far as I'm concerned!

So there was a faulty radio so they bought a used one off eBay.

They fitted (not well) but assumed it was working and you did as well to start with.

Now it'snot working so you need to take the car back to the dealer for them to fix.

Yes! I want THEM to fix it! They want to use my warranty to repair something they caused.

For example if they had replaced a lower front wishbone arm with a badly worn used part which failed straight after purchase should I have to foot the bill. This is what will happen if THEY use the warranty I'M paying good cash for!

Right. Regrettably, YOU are responsible for getting it back to / from them.

As to the warranty, I'd point out to them that they provided a car that was obviously faulty. Under CRA (Consumer Rights Act 2015) they are responsible for fixing ANY fault that occurs within the first six months. It is nothing to do with the warranty.

Read up on the CRA. Make your communications with the garage by writing (email), confirmed receipt, and back up with a copy in writing, sent by registered post.

Inform them that, unless they agree to their obligations IN LAW, you will arrange for the work to be carried out locally, and will pursue them for the full costs of any work in Small Claims Court. If they do agree to carry out the work, you expect them to provide you with a courtesy car for the duration of the repair work, as it is their negligence that has caused this problem. Also explain that you are giving them 14 days in which to reply, and ALL communications are to be in writing. Explain in the letter that if the 14 days are up with no reply, there will be no further request from yourself, but you will proceed with the work, pay for it, and invoice them once complete.

Once that 14 days is up, if no reply, get the work done, pay for it, invoice them (giving 14 days for payment), and if it isn't paid, start proceedings

This is very much the sort of insight I was hoping to get from someone who is more knowledgeable than I in terms of my consumer rights.

I was comtemplating doing as you suggest, paying for the work myself, sending them the invoice and stating they have a limited period to settle up with me before going through Small Claims.

It's a great help and very reassuring to see that I have these rights in Law now! I will read through your CRA and the links you provided.

Wonder if I could ask your advise RobJP on the actual radio itself.

The sales manager has stated that he can't guarantee that a new radio will be fitted and that a used or reconditioned unit maybe installed instead. Do I have any right in law to demand a "new" radio?

I have already penned a reply email which I will back up with a letter via registered post. I have also CC'd my email for the attention of the dealerships general manager who I believe is to be informed in the event I am unhappy with a complaint I'm making which isn't resolved.

Fiat sadly are still known for poor quality and poor customer service. A local garage gave up their franchise 3 years ago due to complaints about the quality of the cars and often had to carry out warranty work themselves as Fiat had plenty of small print about what wasn't covered in their warranties and the dealer didn't want their reputation to suffer. Also a mechanic I know says the cars are far better rust proofed than they used to be, but Fiat electrics and build quality are still awful.

I don't think Fiat can be blamed for this as it's clearly the fault of someone at the dealership. The radio is a Visteon which I understand are also fitted in some Ford's albeit they're given a different facia but the same box of tricks behind that.

I had a Grande Punto a few years ago, it was reliable, generally very good and so was the service I had through a Fiat dealer here in Coventry. The car just proved a little small for our needs eventually.

There are no really terrible cars these days, certainly rust has been beaten and cars can be trusted not to break down on long journeys, but I know Fiat still seem to be in the bottom in most motoring surveys. It's a shame as the driving experience is good, they are very cheap to run and they are one of the cheapest cars to buy used.

I think all cars have some flaws. My Ford Fiesta had its lower radiator hose fail at 40,000 miles, which is a common fault, and Rover had HGF failures on its K series engines.

No, you do not have the right to demand a brand-new radio is fitted.

However, you can remind the dealer that, under the CRA, they get ONE attempt to fix. If the fix fails then you still have the RIGHT, in law, to reject the car, and they can only make a 'reasonable reduction' in the refund price for 'fair use'.

So yes, they can fit a second-hand or refurbished radio. But if the repair fails, make it very clear to them that you will be enforcing your legal rights.

I would rather a new radio but understand from what you say I may end up with something else.

As you say I will be reminding them that I will continue to come back for repairs should their replacement(s) fail.

Knowing that they will hopefully decide a new one is the best option for their pockets!

You could always ask the dealer how much a used or reconditioned radio would cost and how much a brand new one would cost, then offer to pay the difference.

But I wouldn't start with this offer, I'd try very hard to get a brand new one out of them, regardless, first.

I'll bear that in mind Galaxy.

I know that the radio from eBay was up for sale at £75.00

When I enquired with my local dealer on a new radio they quoted in the region of £450.00. With that sort of price difference I won't be offering them £375. I could buy a new all singing and dancing satnav jobbie for less than £375 anyway.

Having said that I'm fairly sure their Fiat trade price pay will be considerabley lower than the price quoted to me.

An update on this for RobJP and Galaxy etc.

I took exactly the stance on the CRA 2015 outlined by RobJP, emailed and sent copies via recorded delivery to both the Sales Manager and the General Manager at the dealers giving them a 14 day deadline.

Within 48 hrs I had the General Manager contact me stating this had gone on for too long and needed sorting. She asked me to contact another Fiat dealer closer to me, near Banbury, who had agreed to do the work for them.

I did as asked, all was fine until they asked why I wasn't going back to the supplying dealer. Told them the saga about the eBay radio, the damage and the fault. Service Manager there immediately declined to get involved!

Back on to the General Manager via email! Proper stroppy reply from her telling me I was to blame for this going wrong as both the other Fiat dealers had been willing to help until I spoke to them! I Pointed out this was totally wrong and untrue, in no uncertain terms.

Was then informed they would need the car back for them to sort it out. Asked to contact their Customer Relations Manager, who would sort it all and arrange a courtessy vehicle. Getting somewhere it seemed now.

As arranged afterwards took my Bravo in on 8th February and was greeted by a pleasant lady Customer Relations Manager who quickly organised the courtessy car while they had our car for a few days. She was going to keep us updated daily as to progress on the radio/vehicle, Totally differnet attitude from her compared with the others there.

Well for four days we had the daily update from the CRM that they couldn't replicate the fault. Had to say to her twice "never mind the fault what about the radio not being secured in the dash" because of the damage and the danger it put us in if we where involved in an accident.

On Thursday afternoon she rang again, same thing and said I would have to have my car back and return it to them if the fault came back! I was starting to dispare yet again and challenged her about the radio being totally unsafe. She stated she wasn't mechanically minded but agreed to go and take a look at it herself and get back to me shortly.

I'd had enough now, so on the phone to Fiat Customer Service, very nice lady with excellent English over in Italy! Took full notes on everything that had happened. Stated they would investigate my complaint about the dealer using used parts contary to Fiats policy and the problems I'd been having getting it sorted since.

The Customer Relations Manager from the dealership called back. She had seen the radio and how badly fitted it was. She stated she had told their staff to replace the radio!! Result! She stated one of the service staff would update me on Friday as she had the day off.

Friday came and no call from the dealer up till 4pm so rung them anyway. Got to speak with the guy I was told would contact me. Seemed very cagey about telling me anything other than "parts had been ordered" and CRM lady would contact me Monday when she was at work next. Not to happy with his response to be honest.

Saturday morning another Italian lady from Fiat rang me saying she was investigating my complaint. She agreed totally with my complaint and had been trying to speak with one of the managers at the dealership but couldn't get hold of one of those concerned, what a surprise on a Saturday, hey!

Monday came and the CRM called me again. Stated they had ordered a BRAND NEW radio! At last! Said they would have the radio fitted Tuesday morning and I could return my hire car midday and pick up my Bravo then. Had to put them off until Wednesday as we had the gas man coming.

Can't wait to here a full update from Fiat about how the dealer had dealt with all of this, the Fiat ladies I spoke to seemed very pro for the situation I'd been left in by the dealer repeatedly.

Does seem though that the dealers final realised how bad this was when the CRM got herself into the workshop and actually looked at the radio for herself and told them "SORT IT PROPERLY" a day before Fiat contacted them.

Glad to see that (eventually !) it seems to be getting sorted. Pain in the backside that it has been, unfortunately, such a long-winded process to get there.

You may find that the dealer is on Trustpilot or another such review site. As such, you may be able to leave a review for them on there. I'm aware that HJ doesn't allow poor reviews like this on dealerships - understandably, as there is too much potential for false reviews to be left, and websites can be held responsible for those, in law.

Many thanks for getting back to us with the outcome, and here's hoping it's all as promised, especially with Fiat (Italy) now getting involved and on the dealer's back too.

Just a shame that you've got to threaten a garage with court action to get the basics done.
