Ticket for defective brakes - Can I appeal?
I have been stopped and issued a ticket for defective brakes on my motorcycle. The punishment is a £100 fine and three points, this is due to me apparently have no rear break pad left on my motorbike brakes.
I was very surprised by this as it is regularly in the garage having something done, I was even more to find out that the back brake was jammed and believe this is due to the policeman repeatedly revving at maximum and applying the back brake only at maximum, hence jamming it. I feel this conduct was wrong and I should appeal.

You don't have to accept the fixed penalty. You can challenge it in a magistrates court. However, you should take legal advice from a solicitor before doing so because if convicted in a magistrates court the penalty will be more severe.
