Went to the small claims court and lost. Should I appeal?

I bought a second hand Audi TT in February 2012 for £4750. I bought the car on the condition that the cam belt and water pump pulley were replaced, with us paying half the £180 costs. Three weeks after collecting the car a problem arose with the central locking; I took the car to a dealer for diagnostics and some £1900 worth of faults were found. I contacted the garage I bought the car from and they agreed to fix most faults, but six months later the problems returned.

I took the garage to court after six months of waiting only to be told by the judge that I am responsible because I didn’t check the car properly. The judge used the phrase "buyer beware", quoting the sales act, so we lost the case. Surely the judge is wrong as this was a garage sale and not just some advertised car?

I am thinking of appealing, but this will cost me £200 per hour in solicitor fees and the defendant's costs if we lose. What’s your honest opinion?

Your problem is that you attempted to sue for faults that developed after six months. To be successful, you needed to prove that the faults were present when you bought the car. Check the law here: www.honestjohn.co.uk/faq/consumer-rights/
