Am I legally permitted to undertake on the motorway in heavy traffic? A policeman stopped me from doing so.

Last year you published a letter from someone about passing on the inside lane on a motorway. The writer said he had been summoned by the police and defended the case. He was acquitted because the court ruled each carriage of a motorway is in effect a one-way street, and since he had not been driving dangerously, no harm was done in passing traffic in the outside lane(s) if the lane in which he was driving was clear ahead as can be the case with a one way street.

The other day on the M4 in the rush hour, I was in the inside lane which was clear ahead for about 200 yards, there was a motorcycle policeman in the middle lane alongside me, and the outside and middle lanes suddenly slowed almost to a halt, I was about to continue in my clear inside lane when the policeman gestured to me to hold station so I had to slow to the same speed as the other two lanes instead of continuing to drive in my lane. No doubt had I passed him I would have been stopped and been given a ticket and fine of some sort. This is an extremely important issue that needs to be put to bed and it would be very useful if you could champion it via your letter pages in order to achieve a resolution.

I have no record of this, so maybe you read it elsewhere. But I would like someone to give me the detail of this case law. You describe having been held back by the police motorcyclist. Whether it would have been legal to pass on the inside or not you have to comply with the instructions of a uniformed police officer because failing to do so is an offence in itself. He might have done that because he thought there may be an obstruction or a crash ahead.
