Dealer sold a faulty car - does "sold as seen" apply?
A colleague purchased a 2007 car three months ago from an independent motor trader. Last weekend the engine fell out, causing extensive damage and leaving him out of pocket and without a car. He has asked the dealer for redress. He rebuffed the request, stating his position as "sold as seen". My colleague bought an extended warranty from the garage but the damage is not covered. What advice can I give him? The purchase was just under £5000 so the Small Claims Track is an option.

If he bought from a dealer and was sold a warranty with the car, then "sold as seen" or "sold as a trade sale" does not apply and the dealer is liable. More on the law here: www.honestjohn.co.uk/faq/consumer-rights/
Of course, winning a case against a scumbag dealer does not automatically mean he gets his money back. The dealer may defy the court order.
