Who is to blame for this accident?
I recently had an accident, a minicab came at me round a bend on a private road into our Estate in the middle of the road and in my opinion too fast, I swerved to avoid and hit a small tree.
My car is currently being assessed for damage. My concern is that the Minicab Firm use the same insurance company - namely Aviva, and even if I could prove it was his fault, (and no witnessess make that unlikely) they are in a no win situation, I am worried that I may not get an unbiased review and result what can I do?

Not much you can do. If the minicab did not actually crash into you then you cannot prove anything.
