Who pays for the problematic exhaust?

My son bought an Audi A6 2004 model from an independent dealer. After 2 weeks the exhaust needs replacing. The garage initially said it would not pay as their warranty did not cover exhaust wear and tear.

My son threatened legal action and eventually the dealer said they would pay half, but that still means my son has to pay £300.

Surely the dealer has the responsibility to rectify the exhaust as he obviously sold a car that was not fit for purpose as well as not being in a roadworthy condition.

An exhaust cannot fail all of a sudden in 2 weeks! Please advise as my son and his partner are expecting their first child any day now and can do without this hassle and expense.
